I am a bit confused, when do I fill this out? The fafsa I mean.

I got accepted to Baylor and they told me I could fill it out right away for my Fall 2010 school year using my 2008 tax return. But my counselor told me that I have to wait until my 2009 tax return if I'm going in the Fall semester because the 2008 one only applies if I'm starting in the Spring.

So....do I apply now or wait for the 2009 tax returns?

Wait. The new FAFSA for the 2010-2011 school year will be available 1/1/10 and that is the FAFSA you will need to use. It is also easier if you have your 2009 tax returnes completed. Check the college's financial aid website for dates - most schools require the FAFSA by March 1 - but check for your school's deadline date.
