SAT material is copyrighted, but they have no rights to impede on your 1st amendment, whatever their policy states. If they find out, I suppose they could invalidate your score, but that's a policy I haven't seen them pursue.

Essentially, the embargo here is to prevent people who are still taking the test from somehow accessing valuable information (time zone difference). The embargo ends not because of copyright lift but because of people being physically done with the test, so the moral standards against cheating are upheld.

That's my best guess at least.
