In 5 states(including CA) undocumented students can attend state colleges and pay in state tuition.
However, with foreign students who hold I-20 visas, they pay out-of-state tuition.

^^Yes. Most colleges require that the student has to be present in the state for purposes other than education to be considered domiciled in the state. An educational visa holder, by definition, is there for educational purposes.

People come here on a tourist VISA and lose the VISA would be considered illegals is it not. One of the girls that is a cofounder of the Dream Act did exactly that.

Most Chinese students who come over for high school have money and they are not going to jeopardize their future employment prospects without valid visas.
In China in order to obtain US tourist visas, one has to prove substantial assets to ensure that you would return.

They didn’t physically “lose” their visa like they might lose their car keys; they OVERSTAYED their visa. It doesn’t matter how the person originally arrived. It only matters what their present residency status is.

In all the foreign countries our family ĺived, we entered legally and had a work/residency visa w a defined duration. At the expiration of that visa, we didn’t expect the host country to pay to enroll our kids in college.

Yeah but I’ve hear on radio one guy from Africa, he overstayed his VISA. His status went from legal to illegal in no time.
I know plenty of Chinese from China who aren’t wealthy. They could be students too. Not all come from wealthy families either.
