Clock Boy's defamation lawsuit thrown out

@busdriver11 It was difficult for about 6 months. The overarching benefit is that I am completely fluent in two languages. I can ‘think’ in either language. My parents were of the opinion (as were most of their cohorts) that it made no sense for them to teach their kids English with a bad accent. The ability to learn languages changes as one ages. Sometime around the ages of 9-11 the process begins taking a different brain pathway (as per a PBS program I watched years ago).

I took the same approach with both of my kids. D - being the elder - entered pre-school with little English. S was exposed to more English because of his sibling’s influence. Both are now completely fluent.

A recent interviewer was delving into S German skills. When S asked why it was so important, the interviewer said that because he learned the language so early and so ‘naturally’ he was capable of thinking in both languages. I guess it’s a rare skill.

I am grateful to my parents. I’m also a big proponent of complete immersion for students entering our school system. ESL seems to delay language learning. Especially if they enter at a young age. IMO, the US starts language education way too late.

Please excuse the tangent…now back to the regularly scheduled programming.

I haven’t read all the documents, and probably won’t, but the decision probably stands for the proposition that insults and speculation about motives aren’t defamatory in the legal sense, because they aren’t facts. It’s surprising that the plaintiffs have to pay the legal expenses of the defendants (not typical in US courts), but that may be because of the SLAPP element of the case.

This poor kid is such a pawn. Daddy wants that 15 minutes of fame to last a lot longer, and get a payoff.

If they had facts to prove their case why weren’t they presented in the original complaint?

A complaint does not have to state all facts. In fact, no pun intended, most facts are uncovered during discovery.

It sounds like it was a complaint drafting deficiency that can be fixed.

Looks like it’s finally over for Clock Boy and his father. I just hope they have to pay court cost and legal fees.
