FDCPA Section 809. Validation of debts [15 USC 1692g]</p>

<p>(b) If the consumer notifies the debt collector in writing within the thirty-day period described in subsection (a) that the debt, or any portion thereof, is disputed, or that the consumer requests the name and address of the original creditor, the debt collector shall cease collection of the debt, or any disputed portion thereof, until the debt collector obtains verification of the debt or any copy of a judgment, or the name and address of the original creditor, and a copy of such verification or judgment, or name and address of the original creditor, is mailed to the consumer by the debt collector.

<p>She was ready to fight it, even knowing that the best probable outcome was to get her story into court records. Fortunately we were local. So she took a day off from work and went to court. The prosecutor listened to her explanation, and offered to halve the fine. The traffic courts here take a “you’re guilty unless you’re willing to spend money to prove your innocence” viewpoint. Most tickets get paid obviously, and there’s still lots of work for lawyers handling the rest.</p>

<p>There have been some locals in VT that have gone to court and had these things dismissed. If you are local it is definitely worth it. Worth the price of a ticket from California to Vermont when the ticket was $59. ? Nope.</p>
