Flip This House # 7

Yes, I agree that he wants both sides of listing. I asked him if he would represent me yesterday morning and he never replied

well, that’s probably because he knows you are going to want to submit “low-ball” offers.
My hubby has given up representing buyers who want a bargain, when there are more buyers who want , and can afford to buy a piece of property, no matter what . He doesnt earn a dime for the time spent writing up an offer that doesnt have a chance of acceptance, in the current market…
sorry.

Why do you keep trying to do any business with this guy.

I agree with emilybee… I know he’s got a listing you’re intrigued by, but – it’s never going to happen. Who knows why. I think you should just avoid him and all of his listings. Really. I don’t think there’s anything in it for you to pay him and his listings any attention.

But @menloparkmom

IIRC, on one of the last houses…the actual sale price was VERY close to the offer CB made…which this jerk agent never presented to the owner for a counter. Which CB would have met.

This agent is smarmy.

the problem is in a hot sellers market- a buyer can’t afford to hold back on the price they would "ultimately’ be willing to pay for a property when making an initial offer. some sellers and agents consider that “playing games” and when they are holding all the cards, as they are in a sellers market, they see no reason to wait around to see if someone will offer more. Fast sale, quick close at a high price and everybody is happy.
Some agents wont see the need to counter lower offers if the seller is happy with the higher offer they accepted.

And no seller is not going to care what a potential buyer “would” have offered, If only they had a second chance.

cb’s strategy is going to have to change…

I speak as someone who has been a witness to the ups and downs of real estate markets here in Calif for over 45 years.

It probably goes against your nature but just don’t bite next time. Take the couple of hours your inspection would take, and any money saved, and go visit a wine bar. Take a nice photo of yourself with someone beautiful, holding a lovely beverage, and post it on instagram. Tag him. And make sure you caption it something like “enjoying a couple of hours with friends!”, or “what better thing to do today than relax and enjoy life!”, or “just waiting for Serge to fire up the hot tub for our little party!”.

But @menloparkmom this agent didn’t even take the offer TO the buyers. At all.

Sorry…but where I am, all offers must be presented to the sellers…for their consideration. It is not up to the agent to vet these offers.

This previous seller could very well have had a much earlier sale…for the same price…if the agent had given the seller the offer CB made.

I think this agent it s jerk.

I agree with whomever wrote upstream…stay away from this guy…let the others deal with him.

real estate law varies state by state.
The “jerk” works for the seller and it is the sellers agents best interest to get his client the best price, at the best terms.
If CB’s offer was below other offers, [and given that the agent knows that CB has a history of low balling offers, and her goal is to get the best possible price, which may not the the same goal as the other buyers], then if he is not legally required to do so, why “muddy the waters” by presenting a lower bid ?
That is why I think CB needs to change her modus operandi , and her credibility, with this guy.
just my 2 cents…

The buyer has to see all bids. This is basic agency law - unless CA changed it by statute or some other way, it is not the agent who calls the shots, it is the principal. I work in an agent capacity, which means I have to tell my clients what the strategies and means there are that could get them on or close to their goal. The clients then make the final decision - even if I personally don’t think it is the best one out there. A lower bid could have other attractive features to the seller such as no contingency etc.

I believe @menlopark makes some very valid points. Our market has stalled a bit for properties above the $1.5 million mark but the lower priced homes are hot. He purposely priced it low to generate multiple offers.

I didn’t ask him to write up my offer since he didn’t agree to represent me. Wrote up the offer myself, executed properly on all the correct forms including the Buyer Non Representation form. My offer, with the concessions and terms was $35,000 over asking.

All I expected was a confirmation that offer was received and a response explaining Seller had accepted another offer.

I do understand that he doesn’t like working with investors so I’m not going to bother him anymore.

You are smart to avoid wasting time and energy with slimy/swarmy creeps. There are others out there who know you do great work and are happy to work with you.

I don’t feel this agent is ‘slimy’ like the Chicken House agent, I just think this particular agent feels he is too busy and important to deal with me. I have spent several years trying to figure him out. He does not deal well with the other local agents, not a good reputation. but he gets a lot of listings because he does a lot of marketing and expensive mailers. I think, because he is not working for a big national firm, he might charge lower commission rates than others.

Oh I thought it was the Chicken House dude! Wow… there appears quite a few bottom feeder types selling Point Loma.

This is the same agent who was selling Tivoli and Charles. He played games taking them off market and bringing out as a new listing at higher or lower prices for months. At one point Charles came out at a price very close to what I had offered weeks earlier. I called him up and he said “I just listed at that price to create a bidding war, we’re not accepting offers at that price”. Well, that theory backfired. He didn’t get any offers. So I just sat there scratching my head and gave up. Tivoli never sold and they took it off the market and tried to rent it for several months, it finally rented at a much lower rent amount. Charles sold about 6 months after it originally listed.

Sorry…I thought it was the chicken house dude too!

Unfortunate, but advisable.

Well, that might be standard realtor behavior in CA, but it isn’t here!

It is NOT Standard Realtor behavior in Calif, but it DOES happen.
There are unscrupulous *%$#^^% in all businesses, in case you hadn’t noticed.
And CB is wise to stop trying to do business with him, as it is a lost cause.
