Ok…I found out that USAgencies isn’t her insurance company. She emailed me a copy of her actual policy from a Texas company called, Affirmative Insurance. It appeared that her coverage is up to date…thru Dec.
She gives me the claim number and adjuster’s phone number.
All of the sudden, I became excited that she might actually have insurance!
I use the company’s online method to add in my info (using this lady’s claim number). I can see a PDF with her car’s estimate, photos of her car’s damages, how much the insurance check was made out for (minus deductible) and I’m very happy.
but…alas…when I call the adjuster, I’m told that they have denied the claim. When I ask why they paid for her damages, the adjuster denied that they paid. When I told her that I could see all that info on their own website, she denied that I could see it! lol…I downloaded the PDF, so I do have it!. She (the adjuster) told me that they denied the claim because of “personal info” about their insured person. ??? She refused to discuss what that “personal info” was. I kept asking about the check they paid and she stopped talking.
So, I emailed the Saudi lady to get more info. She told me that they did issue a check, BUT THEN cancelled it because her license had expired 2 weeks before. So, her car still hasn’t been fixed.
Well, this is a Texas company that probably doesn’t know Alabama driving laws. In this state, there is a 30-60+ day grace period for DLs. This is a rural state so there are many “grace periods” for various things because there is an understanding that rural folks often can’t get to the “big city” to handle business affairs. Plus, in this (odd) state, DLs don’t expire on your birthday (like many other states), so you don’t have that natural reminder to renew. Plus, the state doesn’t send reminders, etc. So, they just have a generous “grace period” to solve all these issues.
So, technically, she was still ok with her license. (there’s another issue that her education visa expires in Dec, so she isn’t able to renew it anyway…she was told that when a DL is expiring within XX days of a visa expiring, that int’ls are allowed to drive with expired licenses…don’t know if that’s true. Don’t know if that is a fed thing or an Alabama thing. Wouldn’t surprise me if it is true, because why have an int’l go thru the hassle of a renewal just for a few extra months.)
So, I don’t know if her insurance can be “forced” to pay or not. My Allstate adjuster must have been off this entire week because she didn’t return any of my calls. My agent tried to reach her and also wasn’t able.
the weird thing is…the Saudi lady has paid thru Dec. So, if they’re saying that they won’t cover her because her DL is expired, and she isn’t able to renew it, shouldn’t they be obligated to return a pro-rated amount? I don’t want to suggest that now, because I’m still hoping that they will be required to pay our claims. She is the only person on that policy…and the policy does acknowledge that she is living in alabama.
Side issue…I got my car back this week. I was hit on the right side of the car. For some reason, the window control that is on the driver’s side that controls the passenger side is no longer working. I know it worked right before the accident because H accidentally nearly closed it on my hand earlier that day!! (I was dumping water out of a cup and H started closing my window) The shop is saying that the switch is bad on the driver’s side…but it’s just too weird that it would suddenly “go bad” at the time of the accident. This switch part is $200 plus labor! lol. (crazy!)
Also…when I picked up the car, and put it in reverse, the car literally vibrates…but only in reverse. I immediately told the shop manager, he tried it, and he clearly agreed that the problem exists. He took it back in and then said that his mechanic said it’s because the car has 100k miles on it. AGAIN, this problem did NOT exist prior to the accident. I just think this is too weird.
