<p>Addressing another point. Certainly, something is better than nothing. The issue some (my husband, other Board members, me) is not accepting 50% and moving on. The concern is: precedent…and how other ‘deadbeats’ may take advantage of it; legal exposure… to those who may think the short sale damages them whether they be current or future home sellers or just residents who think their Board should have negotiated better than 50%; and authority… our charter is not clear that our Board members can actually legally make this deal. But you are absolutely right, foreclosure yields zip for the HOA. On the other hand, foreclosures are not included in comps. </p>

<p>As I said, our attorney and management company are pretty lacking. They shouldn’t be…but they are. They will likely be replaced soon.</p>

<p>His story…the HOA attaches a lien, he goes nuts and threatens to sue (apparently he can pay an attorney but not the HOA dues). Then he relents and starts a payment plan. Defaults on the payment plan, the lien process starts over again. This has probably happened three times in 6 years. The Board actually moved toward foreclosure two months ago (legal letters) and he’s back on a payment plan. We’ll see if he sticks it out. I’m sure he’ll ask for a concession after word about the short sale deal gets out.</p>

<p>In the meantime, he has sent a laundry list of complaints about the amenities. (Smacking forehead.)</p>

Just search for my posts on the DOJ attorney who wants to install surveillance cameras around the perimeter and throughout the neighborhood to combat our horrible crime (teenager drivers rolling through stop signs and middle-schoolers 'teepee’ing houses).</p>

<p>Ahh, you didn’t mention the liens or the fact they’re effective, even if temporarily. He relents b/c he knows he doesn’t have any legal basis not to pay.</p>

<p>Could be worse. A Friend lives in a neighborhood that has a HOA that issues $100.00 fines if your boat is in the driveway overnight.</p>

<p>Erewhon, while not entirely impossible, I doubt you’ll find many people worried about a HOA in Turtle Creek or Highland Park. :D</p>

<p>I think they are more prevalent in suburban high-middle class enclaves.</p>

<p>It was a joke. I lived there ages ago. Thanks to the infamous Shannon Wynne, I met my wife in Highland Park. I have fond memories of Texas :)</p>

<p>Btw…it’s starting. Today, fielding irate phone calls from homeowners complaining about the short sale price. Anyone want a 5500 square foot custom mini-mansion (pool, spa, outdoor kitchen and dry sauna included) for less than $75 a square foot? It really is a beautiful sprawling home on a corner, within one block of the club and tennis courts. The price is unbelievable for our area. </p>

<p>Sigh…my husband cannot come home soon enough. When he is out of the country, I’m the first line of defense against ‘the angry homeowner’. </p>
