Since neither you nor your parents currently reside in either Virginia or California…you would be an out of state student in both places. The California public universities don’t give need based aid to out of state students.

Virginia does give need based aid…but you need to contact them. You have missed the deadlines for filing. They might say it doesn’t matter…but they might say that it DOES. UVA can tell you the implications of filing this late.

How they got the green card doesn’t much matter. The living abroad and “visiting the U.S. from now and then” can be a big problem. The rules on that are constantly changing and can vary by the country the family is from and the country the family lives in. If they are in the US long enough to process formal Reentry Permits, then they can be out of the US for longer periods of time.

If the family intends to move permanently to the US, they should do that. Where they live can affect in-state status for the student, so they may want to be strategic about choosing the best place to live.

Depending on where the student lives outside the US, there will be an office of one of these organizations. Both receive funding from the US State Department to help students find good places to study in the US. Most of the offices do have experience with US citizens living abroad, and with people who hold green cards but are abroad temporarily. If no one in the local office has that experience, surely some of their colleagues in other offices do.
