Accused of cheating, don’t know what to do

During my bio test, I take the exam as normal; it’s only worth 15% of my grade, so I really don’t need a good grade given how well I’ve been doing in the other aspects of class. I take the test with not a lot of pressure, just getting things going. In the middle of the test, the course instructor (who I assumed back then was a TA) gives me a hand sign that she’s watching me. I don’t think much of it because well… I wasn’t doing anything and go back to test taking as normal.

3 days later, I finish my math midterm and feel a ring. Already stressed out, I open it up- it’s a note from the student conducts. Apparently they think I cheated in my biology midterm and need a meeting with my faculty because I get a resolution with the faculty (that is a formal insititutional action btw) since it’s my first time offense. She says she saw me looking at someone else’s exam along with TAs, and offer me to sign agreeing I did along with a 20% deduction on the test.

My faculty+the course instructor is there, saying they saw me look at the exam of the student to the right of me, along with TAs. (KEEP IN MIND: this is a 300 PERSON setting and every TA was a good distance from me). I tell them that I didn’t, thar eyewitnesses are unreliable in this context. Then I ask to take out my exam, the only physical evidence because I know I didn’t cheat, and therefore would have different answers. She declines, saying it’s an accusation geared towards me looking at someone’s exam, not copying answers off… I say it’s ■■■■■■■■, and that I’m not signing their paper and taking it up to an administrative hearing.

I take it to the administrative hearing, and well, it goes as bad as I can. They essentially go “multiple TAs said they saw you doing this, what do you have to say to that.”

I tell him that it’s a 300 person lecture room, that it’s impossible to draw the conclusion that I was looking at someone’s paper so easily as they did in the text messages sent discussing me, and that some of the observations were purely nonsensical- one of them was that “I looked at his paper and nodded” (like who NODS after cheating, ah yes, look at me TAs, I’m cheating). I bring up the fact that they blatantly REFUSED to open up the test for this hearing, (I asked them for it, cc’ed with my administrative hearing officer) and he doesn’t think it’s a big deal. I also brought up the fact that I have a medical condition on the left side of the body so could be leaning a little bit to the right, along with the fact that the student to the right of me took the exam covered, and is willing to testify he did; both gets denied/overlooked. (by the way, faculty also confessed of taking the two exams seperately- yet didn’t present it as evidence, fishy?)

The administrative officer picks their side, going “the student couldn’t present any evidence to deny that the TAs saw me look at the guy’s exam” (like what am I supposed to say? it’s a he said/she said that’s very unreliable.) Now I’m found responsible, and I got a warning, and I don’t know what the ■■■■ I should do.

My dean who believes in me, is also the premed director says this is not going to gatekeep me from medical schools since I’ll get a clean letter, along with a clean disciplinary record and transcript so there’s nothing to gain by taking it to the board hearing which would be the next step if I appeal. However, this entire thing is ■■■■■■■■+I’m worried it’ll impact my medical school applications as a pre-med who’s been dedicated…

You got a warning. Is that all?

yes, plus the 20% deduction, though I’ll have to report this to medical schools when i apply; clean disciplinary record, transcript, and committe letter though

One thought: if you can document your medical condition, can you use it to request different seating for the next exam? In other words, if you’re seated all the way on the right side of the room, it will not arouse suspicion if you are leaning somewhat to the right.

If you have a medical condition, perhaps have a meeting with whoever handles ADA issues on campus (or consider consulting a lawyer if you choose to pursue this). Is your medical condition on file with the university anywhere?

Why do you think several observers think you cheated by looking at others’ tests? This seems very unusual to me.

If you really didn’t do anything (and I personally believe you) I would think about hiring an advocate or lawyer. Are your parents involved at all? I know it’s just a warning but this feels very unjust.

ps I am skeptical of the medical condition as a reason for looking to the right, and bringing that up would seem to confirm you were looking in that direction! I don’t know your condition but if it is truly a reason, then sure, bring it up.

Conditions such as torticollis cause the head to be turned to one side. And could cause spasms. Doesn’t mean they were looking at other papers. That said it may not be a condition that requires an accommodation. But could explain a head posture. Not saying this is what the OP has- just saying there are medical conditions that would/should have been at the outset of this issue if it were a factor.

two things, first because my medical condition is a left shoulder injury, so I just tent to lean a little towards my right when I’m sitting for a long time because it feels more “secure” in a way? Kind of like having support on the joint/muscle. I do have records of me going to the ortheapedic center on campus+physical therapy, though an issue there is I didn’t go in consistently with PA bc money+they told me what to do.

Also tbh I just zone out anywhere and I think they thought it was me looking at his exam, like one of the observation was like… “he was looking at his exam and nodded” which I think, and objectively sounds more consistent to “I zoned out to think of a problem and then nodded once I figured it out”.

Did you bring that up at these hearings? If there is a disability that explains your posture I can’t or at least they shouldn’t penalize you for a medical issue.

OP: Will the warning be a permanent part of your file. If yes, then you should consider contacting an attorney who has experience with such matters.

Did the test contain any multiple choice questions ? Or did the test consist of just essay & short answer type questions ? If the latter, it is hard to understand how one might benefit from glancing at another’s exam paper during a test.

The problem is that several TAs stated that each saw you looking at other students’ tests while the exam was in progress. Despite this aspect, the slap on the wrist type of punishment–a warning–suggests that there is no significant proof of cheating. Nevertheless, if the warning is in written form, rather than just verbal, you should consider consulting an attorney. And, whether written or verbal, the warning probably does constitute damage for one in need of medical school committee approval and recommendations to medical schools, so consulting with an attorney might be reasonable.

I did, he didn’t take it seriously from what I can tell… :confused: he just kept asking why I didn’t get accommodation when that just means I go to a testing center 20 mins walk away and doesn’t solve uncomfortableness

It isn’t something that’s on my out of school files (transcript, disciplinary record, etc) but something I still have to self disclose for med school.

I got my exam back because my professor thought case closed, and there’s a very significant difference (I got 8 questions wrong, the guy they’re accusing me of cheating off of got 1 question wrong). Despite this, idk how it’ll help me because they found me responsible based on the fact that “I can’t argue I didn’t look at someone else’s exam, and that’s what I’m being accused of, not cheating off of someone”

If you have a documented diagnosis, you really should get accommodations. You might be able to get more comfortable seating, or at least a quieter space where you’re not surrounded by people, which means that you wouldn’t have to deal with any suspicions about your posture.

I’m still puzzling over the fact that they accused you of looking at another student’s paper but they didn’t compare answers between the two exams. If you’re accused of cheating off of someone who ended up scoring significantly higher than you, I don’t see how the charge stands. And btw – if you did get a documented accommodation, together with these test results, it might be grounds for overturning whatever decision was made.

Either get legal help or move on. This really strikes me as pretty outrageous, now that we know 1) your physical issue and 2) the answers don’t match. Is there anyone on campus who knows you and could help advocate?

I’m a high school teacher. I taught college for 3 years. During exam time if I think a student might be cheating or doing something not supposed to do, I go tell them right away. If I make the accusation after the exam concluded, my department head and dean of students would ask me if I had given a warning on the spot. If I didn’t, the accusation wouldn’t stand.

I’m still puzzled too, yeah, their accusation/explanation is that “I’m accused of looking at another student’s exam, not copying off of him” which I don’t even know what that means… I just stared at his exam and said “cool my answers are better” or whatever? lol

Essay exam or multiple choice exam ?
