If people are going to insist on the Yes means yes, then I can only think of the drone which can monitor the affirmative yes throughout the act. Without the drone, one party can claim that he/she didn’t give an affirmative yes. We’re back to he said/she said. The drone will spit out the timestamped yeses, zaps by participant accessible via cloud by either participant or LE.

Imagine the problems that YES means Yes would create in divorce court.

SoWhat, you’re thinking that in cases where the two people are going to consent, it may be a nuisance to get consent. But let’s think about cases where the advances were going to be unwelcome. Why should a woman have to be subjected to unwelcome physical attentions? Why should she always be having to fend off guys’ gropy paws and slobbery mouths? Her body is hers, not yours, and you should not be able to treat it as yours without her explicit permission.

The issue with drunken guys and consent can be that while he’s thinking, “Well, she hasn’t said No in the last two minutes,” she’s thinking, “This guy is ignoring what I’m saying and doing. No matter how much I try to repel him, he keeps on attacking me. I might as well submit and get this rape over with.”

Glimpses of someplace i don’t want to go LOL. Anyway, not sure how yes means yes meets friends with benefits which is a for real thing with the kids. I’m in the no means no court but i’ve said that before. It’s clear. It’s understandable…and we’ve all said it at one point or another even in a long term marriage with someone you love dearly.

No civilized country should have death penalty. While we are at it I will abolish the military too and just keep a small self-defence force.
[No I won’t debate on either of these two things, I believe what I believe here.]

Is that a “we” as in the two of us, or as a group? Because I find myself agreeing with much of what you post :)

I asked this before and got no answer.

Zaps where?

TV4caster, as a group. We agree that we agree with most of each other’s posts. :)

I taught my D’s to say, “Stop, you are raping me.” Not sure where that fits in with this discussion.

I love this. This is awesome. Why? Because I believe just the opposite, yet we both like the same judicial system. This is a great lesson in how the Founders understood the rights of the individual, regardless of what the individual believes.

Bay, I think that is a no. :)

Have they had occasion to use that phrase?

You think girls don’t hug and kiss without being invited to do so? Which world do you live in? Huh?

I am trying to focus the discussion to rape which requires penetration and you keep coming back to kissing and groping which girls do just as much as boys (I have seen some real huggers OMG!). Can we just for one post stay away from this groping and kissing thing and focus on rape which requires penetration? Just one post.

I already told you, when a girl can’t even say no, she is legally incapacitated, and more half the cases of rape in the CDC study belonged in this group. But - you keep missing this point - the boy is more than likely completely drunk at that point too. That’s the very very common situation. Both boy and girl are stone cold drunk. No one is giving or getting consent. It’s just plain animal act. You may not like it, and I most definitely don’t have any fond memories of it (but that’s because I have few memories at all from such cases), but that is not rape. The girl is not getting enthusiastic consent either.

Can we please please please come back to the common case of a boy and girl having sex and not drunk or just mildly drunk and in full control of their senses? How do you implement Yes means Yes here?

Not to mention, that while I have never been a professional gambler I have been known to use a few advanced techniques to steer the odds in my favor while playing Blackjack. B-)

Maybe we sat together sometime when I was breaking the normal rules and having people yell at me

" I would hazard a guess that one thing would be to report rapes instead of cover them up, and another would be to expel students for rape instead of just slapping them on the wrist. "

It isn’t for a university to decide if that has occurred. That’s a felony and the province of the judicial system. Once someone is convicted of rape then they are incarcerated and expelling them becomes a formality.

How could it not fit into this discussion? That should be on a tee shirt on his to say “No” without question.

CF,
Not that they’ve shared with me, and they seem to share TMI.

As the mother of both girls and a boy, I have concluded that girls are way more emotionally and communicatively advanced than boys, so they need to take command when boys are overtaken by their impulses. YMMV

I don’t understand this claim. In particular, I don’t understand how a guy is completely incapacitated, yet still able to ****. I also don’t understand what you’re claiming the incapacitated woman’s part is in this scenario. It seems to me that her role is lying there in a drunken stupor, and his role is drunkenly raping her.

You won’t win that one sowhat. There are people and probably posters that deep down think it’s always the males responsibility even when they are both silly drunk. Personally I believe if they are both drinking and having sex they are raping each other so not sure where that gets anyone. If one of them is passed out then the law comes into play and is clear.
