"How would you build a case for Sara? A case that a DA would be willing to take to court because there would be a good chance of winning? It was a pure case of she said he said. I don’t know what happened, neither do you, nor does the judge and jury, so as a cop what would you do?

I am really asking this seriously, because everyone is disgusted at the system, but no one can say what’s a practical way to prevail in court. There was no rape kit. She didn’t go to the hpospital immediately. So what do you do now? "

How about this – it happened in a dormitory, correct? If I were being raped or otherwise sexually assaulted, I would be screaming my head off, fighting back, whatever it took. Other people HEARING screams then becomes “evidence” of an unwanted encounter. So do bruises on either party.

Why are these women not fighting back? That’s one of the first things I was taught when I was a kid.

Is the problem that some of these people are boyfriends? Well rape is rape. And if it’s rape, it warrants fighting back.

sorry double post.

I didn’t say completely incapacitated, I said legally incapacitated, i.e., when someone can’t make any rational decisions because the mind stops working but the basic bodily functions still work. <shakes my=“” head=“”></shakes>

You also are projecting when it comes to the role of the drunken woman. She is on the top cowgirl style just as frequently as she is not, and for some girls who are into domination, they are almost always on top doing unmentionables that will make your stomach crawl so I wouldn’t say it here (I like it though!). Even when they are drunk. No, especially when they are drunk.

You have this view of college girls being chaste flowers and boys being rogues. That’s very Victorian. It is a new generation and people are far more sexually open and advanced. Ask your college age daughters. If I tell you the number of times I woke up from a stupor handcuffed to a bed … and this is with the plain vanilla girls and not those who are into S&M. (I like them all.)

Sex is not just about missionary anymore.

I think it’s the active person’s responsibility, and drunkenness is no defense for rape or any other crime. The active person would typically, but not always, be the male. The passive person, the one who is lying there in a drunken stupor doing nothing-- that would be the one who is being raped.

About a hundred pages ago this discussion was happening and the outcome was that some women freeze up literally, they don’t fight back and they don’t scream. I tend to believe this because humans do divide that way when in crisis - some freeze and some act. I’m a fighter, it would be a rare moment for me not to fight like heck and act decisively, but I do know people can just freeze.

I remember reading a study 20-30 years ago that despite the perception that most college sex acts occurred when the girl was drunk and the guy was sober, that the reverse was actually the case. The theory was that a college girl who was being plied with drinks was more cautious because they could tell the intentions were not necessarily noble.

Women getting guys drunk, but being sober themselves (or at least not drunk) gave the guy the best chance of having sex.

Given the changes in both drinking habits and social mores I wonder what a current study would show.

Remember when I said consent by word or deed? That would be one of the examples of consent by deed.

(edited to add) And I have no patience with that woman, the one on top cowgirl style, later claiming she was raped because she wouldn’t have consented if she had been sober. If she doesn’t like what she chooses to do when she chooses to drink, then it’s up to her to make different choices.

Well, two things. First, that’s sexist. That’s likely some second generation outdated feminist concept (IDK) that current generation feminists would laugh at. I know my female friends would if I were to tell them that they do not have any responsibility and the man makes the calls.

Second, the law is with me so the problem is not mine, it is that of the people who are out of touch.

OK, may be that’s how sex was in the 70s. LOL. I will say no more. But the world has moved on from missionary.

@bay"I taught my D’s to say, “Stop, you are raping me.”"

I think that is good, and is completely clear. However, I can still imagine the "She never said “No” argument coming.

Ughhhhh

Frankly very few cases of drunken sex ends up in a complaint of rape. It only happens after the fact when the boy dumps the girl but even then MOST girls like 99.999% do not do that in my experience. In general kids are not psychos, neither boys nor girls. A few bad apples ruin it for everyone.

Boys whine too when dumped and claim that they were taken advantage of. The CDC survey is full of such cases on male complaints.

The law is not with you, SoWhat.

SWD, not all people from the 70s that think this stuff. I am from in the 70s, actually before, and I confirm there is nothing more active than a female doing cowgirl with the guy being the passive one in most cases.

Who said that…OMG. I assure you sowhat that was not true in the 70s.

CF, What I mean is that the girl didn’t take consent either as both were drunk so the boy can just sue the girl back. But seriously, you know, we are making mountains out of molehills here. in the CDC survey the girls reported drunken sex but also said that it was mostly not upto criminal standards of rape. It was just drunken sex. You should read the survey to see the current attitude of young women. I keep reading you and feeling that you are out of touch.

Cardinal Fang said that. May be it is her personal preference then. (No judging though.)

TV4caster, :)

SWDY…Your generation hasn’t invented any sexual positions.S&M has been around a long time. ;)

I have 3 kids but I have had sex at least 4 times. ;)

I understand the hook up culture and I can see the positives. :)

Guess what ? There are negatives too. I like mocha ice cream but I can’t just eat what I want. I still have to be careful.

You play… You suffer the consequences if the game goes bad.

What are the odds you are going to be accused of rape? Very low right ? Way less than the 1 to 2 percent of women who report rape, right? All those hormones flying around… There must be a lot of sex.

You thought 1 to 2 percent was low. Your chances of getting in trouble are lower than that. So what is the problem?

You are risk averse?

Truth be told I never worried about false accusations. Not in college, not now. I just remembered to always stop when asked to and there has been many times when I had to do that. I stopped because to do otherwise would be rape (roleplay is different).

Yeah… You did say that. :)
