They declared Chapter 11 yesterday. This is not a shock, as they’ve been embroiled in legal and financial troubles for some time now.
We are existing lease customers. One of our inverters stopped working in May, so we’ve only been producing 50% of our system’s potential since then . It took until July for a service tech to come out. We were scheduled to have the repair happen two days ago. Late Monday night, we got a text saying “we cannot complete this service request. Thank you for your understanding”
Although our contract states that SunPower will reimburse us some paltry amount if we don’t make our annual production target, given the bankruptcy news, I can’t imagine we’re seeing that payment. In the meantime, we’re still making lease payments (as well as actually paying electric bills and getting a diminished return on SREC payments). I’m thinking we need to meet with an attorney to see what our options are.
Anyone else in this boat?
