Seems to me a private Snapchat photo mocking a prior blackface event is within the student’s First Amendment rights. Having the police investigate seems a violation.
No such thing as a “private”snapchat photo. Just as there is no guarantee of privacy on FB or any other social media platform. Posts can be screenshot and published all over the internet. Plenty of people lose jobs, friends and college acceptances because of what they post. First amendment allows for freedom of speech but not freedom from accountability.
Public entities have to be very careful about violations of the first amendment. This is a state school, right? And they are looking at this from a criminal perspective?
Cal Poly is a state school. The police are not investigating; the California Attorney General’s office is investigating. They are not investigating to turn up crimes, but to see whether CSU policies are being flouted.
“Retained” is a strange locution to use here. I didn’t realize public entities could “retain” the California AG. But in any case they’re not looking for crimes.
