car title question

Wondering if any of you would know how to proceed on this. Son graduating college to start job in MA. We have let him use our old car registered in NY. He will now need to register inMA. Would we just sign the title over? Would there be any tax consequence. Thank you somuch!

I can speak only for NJ but I would think most States are similar- no tax. You are allowed to give him the vehicle.

That does not mean he will not be contacted and asked why he did not pay tax when he registered the car.

"If you move into Massachusetts within six months of purchasing a new or used car, you must pay either the full sales tax on the car or the difference between the Massachusetts sales tax and that of the state where the car was purchased. More specifically, if Massachusetts:

a. has reciprocity with the state and you have proof that the sales tax was paid in that state, you have only to pay the difference between the tax rates of the two states.

b. does not have reciprocity with the state where the car was purchased, then you must pay the full Massachusetts sales tax. No sales tax has to be paid if the car was purchased out of state more than six months prior to your move."

MA residents also pay a car excise tax every year, though it’s not very much on an older car.

We just did this with a car from Florida to New York. The MA dmv site probably says what is needed to transfer a car given as a gift. If it is from parent to child there may not be a tax, as tom says. We needed a “bill of sale” signed by them and us. On the NY registration form it asks if the car is a gift and if it is a gift from parent to child, or spouse to spouse (or several other qualifying connections), in which case there was no tax.

Son just registered ‘his’ car that had been registered in my name in NJ.
I signed back of title, $1 purchase price, and he paid 7 cents in NJ sales tax when he got the new title in his name. This is a 12 yr old clunker with >120K miles worth maybe a few hundred.

Don’t know whether same would work with a car worth substantially more.

Son moved from MA to NJ, has lived there for 9 months but car is still registered in MA in our name because he’s living “temporarily” with his grandparents and looking for an apartment, which he hopes to move into this summer. (It’s a 15 year old car with 100k+ miles). If he ends up living in NYC he will sell the car, but he’s also looking for an apt in NJ so may end up keeping it. In the mean time the car is still on our insurance because it’s titled in H’s name, and S pays me for his share of the car insurance. Insurance knows the car is garaged in NJ.

He has the title to the car and H has signed it. If he ends up settling in NJ and keeping the car, we will “sell” it to him for $10 and he will title and insure it at his new address. If he ends up selling the car, he will just fill in the buyers’ name on the title.

Yes, I know the law in NJ says 60 days but he didn’t want to have to re-register the car and then change the address when he finally finds a place to live. He takes mass transit to work and rarely drives it anyway.

If the car is transferred Parent to child in MA there is no sales tax.
