<p>My S and his roommate are vacating their apt this weekend, and looking to sublet for the remainder of the lease (through August.) They have been getting a fair amount of interest from people.</p>
<p>My H (who’s name is on the lease) talked to the landlord to make sure it’s okay. We don’t meet the requirements for formal sublet (according to landlord and to what is in our lease) but landlord said a “casual sublet” is fine. The landlord will require name, phone number, and copy of the subletter’s driver’s license.</p>
<p>Formal contracts that are available on line are not appropriate for this situation. What we need is something that says:</p>
<p>The subletter has a copy of the original lease and agrees to abide by the rules. </p>
<p>And the subletter will take care of the place!</p>
<p>And the subletter agrees to vacate by August 31 when the lease ends.</p>
<p>Does anybody have any idea what this thing should say, or how to say it?</p>

Do a letter agreement with your “casual subletter” confirming that he’s subletting the apartment, he’ll take care of the place as specified in the original lease (give him a copy) and will vacate the premises by August 31st.
Your subtenant should get a liability policy so that if someone comes in (a workman, a guest) and gets hurt and sues, the landlord will come after you if your subtenant doesn’t have this type of insurance. Subtenant’s insurance should name the current tenant (your H) as an additional insured party which protects you/him against any claims except for your own negligence. Give a copy of the letter to the landlord and put a sentence in the letter that the landlord and the tenant (your H) can rely on the letter and enforce the lease against the subtenant.</p>
<p>My “house expert’s” firm bills out his time at $535 an hour, but on the Parent Cafe, it’s comped. ;)</p>
<p>Of course, you are still definitely on the hook for the remainder of the lease, so be careful who you choose and keep your fingers crossed.</p>
