Deferred from ED1 to BU, can I apply ED2 to NYU?

<p>Like the title suggested, I got a deferral from Boston University, and now I want to do an early decision II to NYU. Does anybody know if I can legally do this? </p>

<p>BU’s early decision agreement states the following:

While pursuing admission under an Early Decision plan, student may apply to other institutions, but may have only one Early Decision application pending at any time.

But since I got a deferral, does this mean I’m no longer consider an “Early Decision applicant” and regular decision applicant. </p>

<p>The Decision from BU says:

You have not been admitted as an Early Decision candidate. However, your application will receive a second review in our regular decision admission process when we receive your senior grades and the results of any additional standardized tests you may have taken since November.
