False Sexual Assault Accusation Exposed; What Now?

The young woman in the story recanted when witnesses came forward to say that she appeared to willingly accompany the men and initiated the sex herself.

What now should the justice system do to this student, or anyone else whom was found to have fabricated such a tale? Thank goodness it was exposed prior to a trial. Should that fact temper any punishment she might receive? The activity didn’t happen on campus, but she accused two athletes at an off-campus party. Should the college get involved?

She should be prosecuted to the fullest extent of the law.

“Yovino, who was released after posting $5,000 bond, faces up to five years in prison if convicted on the tampering charge, a felony, the Connecticut Post reports.”

Unfortunately a bit late for the football players who lost their scholarships. They could probably sue her for damages.

I think this highlights the danger of a rush to judgement in these types of cases. Unfortunately there is a tremendous amount of pressure on the police and the colleges to do something right away and not wait for due process.

I think ESPN 30-30 did a long documentary on the Duke ( I think it was Duke) team that was accused of assault and ruined lots of futures before it later came out that the accusations were false.

It is so hard to make these judgement calls when such an emotional issue is before you.

The university isn’t saying anything presently about whether they’ll reinstate the players.

That’s good in some respects but the college already convicted and punished the players BEFORE a trial.
Why colleges get to play judge and jury before the criminal justice system acts is concerning to me.

If the college does not take immediate action there will be protests on campus and extensive coverage in the news media. Innocent until proven guilty is not recognized by some who seek “justice”.

My nephew’s ex stalked him on campus and threatened (in writing) to get him thrown out of school unless he got back together with her. He refused and went to his college to ask for help. They were under investigation, and instead of helping him they helped her file a Title IX complaint against him and he had to leave the school. He had reams of evidence showing her harassment, but the school refused to consider it.

I think the instances of false reports are more common than people realize, but nothing happens to students who file them so there’s no deterrent. Students who file false reports destroy lives. My nephew is despondent. This finding will be on his transcript forever. He’s low income, so his parents can’t just write a check and send him to whatever colleges take full pay kids with this type of record. He’s fearful that If he pursues her for filing false accusations, she’ll file criminal charges and he’ll spend the next 30 years in jail. In many states there’s no statute of limitations for these charges, so the threat literally hangs over these boys forever. The girl in this story, and others like her, belong in prison.

Girls like this give real rape victims an uphill climb to prove their allegations. I hope she goes to prison for this.

Well, we shouldn’t rush to judgment on the allegations against her, either. She hasn’t been convicted of anything yet.

I agree. So the college still needs to keep their judgements out of it.

In the best of all worlds it is best to wait for the [initial] results of a substantive and unbiased investigation. However, as MassDad said, nowadays colleges are being scared silly by advocates who want IMMEDIATE consequences for an accused perpetrator of sexual assault.

Well, then the advocates need to learn how the justice system works. They’re in college right?
They can learn something new.

I think whenever one of these types of cases comes up, and there are been quite a few the past couple years, the false accuser should be punished either legally through false accusation or through slander, defamation or whatever you call lying about someone and I think the college should be embarrassed at their rush to judgement and college administrators should be forced to sit through several civil liberties, civil law, sensitivity, and anti-discrimination classes until they get it through their misty skulls that you don’t presume guilt in the US you trust but verify and I think the athletes should sue the college. This rush to judgement without any verification needs to be over, like yesterday. Love your comment @gouf78.
