I’ve been in family court over college tuition. My Ex and her husband make $230,000.00 a year, she inherited $348,000.00 before we were divorced. I live in New York where the courts can make a non-custodial parent pay college tuition. My son is going to a private college which he received an $8,000.00 scholarship. The court could make me pay half of State college tuition. My question is …Will the court take into account the financial aid package he would have received from a State college in determining my contribution?

Did he apply to a SUNY and receive a financial aid award? It doesn’t sound like he would have been offered any need based aid. Merit aid varies by school, so my guess is that this would not be a consideration. At least SUNY tuition is cheap - 50% of it would amount to less than $200/month. If that’s all you get tapped for helping your kid get through college, I’d say you’re very lucky!
