Flip This House # 7

Nature’s Miracle. But it has to be able to soak in. They suggest the black light for checking.

Well, luckily I don’t need to stock up on Pet Miracle products

This morning I did a full title history research on the property, liens, judgments and mortgages. I forwarded to the lawyer that I think the guy owes more than he thinks he owes on the property. He took out some weird Gem and Diamond loans that were secured to the property. Based on this information, the lawyer realized that Seller owes more than he disclosed on the property and there is no way to ‘sell’ the house for the amount owed across all the loans and judgements and liens. These have to be cleared in a sale transaction through title insurance. They do not have to be cleared in foreclosure.

Turns out that the 2nd mortgage holder got really worried because the 1st mortgage holder was foreclosing on the property. The Seller filed for bankruptcy Chapter 13 (where they create a plan to make monthly payments back to creditors through the Court) twice last year to stop foreclosures. The 2nd mortgage holder paid off the 1st mortgage to protect their position. So, 2nd mortgage holder is trying to foreclose now.

The hilarious thing is that the 2nd mortgage holder located in Northern California THINKS they are going to foreclose on a $900,000 property (based on Zillow and comparable sales) for their $575,000 debt. If they foreclose they wipe out the Gem and Diamond loans that are subordinate. They think they have a big bunch of equity - but they have not seen the inside of the house!! At best, they have a $650k house on their hands that is going to take $150k to get cleaned up and fixed up before they can sell. Sure hope they are in the business of remodeling. Let alone trying to evict the Seller, 4 dogs and 12-15 big birds and four ore more truckloads of crap out of the house.

So, the Seller is going to file another bankruptcy today, Chapter 7 that wipes off debt, to stop the foreclosure, trying to postpone the inevitable. He cannot sell the house because he owes more than it is worth. It was another Chinese Fire Drill for nothing. I dropped everything and ran over there for inspection and spent most of the evening crunching numbers and writing up my offer.

By the way, I researched the bankruptcy records and it appears that the gentleman ran the jewelry business out of his home as a reseller and consignment. The robbery was at his house and all of the stuff was not insured. He owes people for all of the jewelry that he had.

Wow, @corslbrook. Sounds like you can write a fascinating novel about all your experiences or a book of short stories at least. Sounds like some bad folks knew that this guy had valuables in his home.

Bankruptcies, foreclosures, robberies, pet elimination, a bird room – wow. Sorry it was a waste of your time, cb, but it sure makes for an amusing story.

Throwing in this listing for fun because I figure they could have paid the windsurfer to be in the background of the photos but how did they get the seagull to cooperate?! http://www.sdlookup.com/MLS-180003841-5316_Calumet_Ave_La_Jolla_CA_92037

That’s a pretty amazing house, but I want to see the house two doors down where somebody has torn down two adjacent houses (valued at $10.7mil and $3.1mil by zillow) and has combined the lots and is building a mega-mansion.

I’d be a bit worried about cliff erosion, too.

@Marilyn – That is some house. Wow. Those are the best views and the best decks/patios that I’ve ever seen. I could even put up with the vessel sinks, if I could have those views.

If only we could have afforded the Bird Rock neighborhood! It would have been our top choice.

It’s funny, the downstairs bed is a Murphy bed.

That is an incredible house with some major expensive constryction stuff. The glass floor deck is amazing! Really enhances the view down to the ocean and lets light onto patio below. But can you imagine the cost to build that?? Also, i can imagine the maintenance cost to keep the tops and bottoms, outside and inside of all that glass clean in an oceanfront environment

The views are spectacular. I hate everything else about it.

I’d love to just sit out in the sun for a bit there.

Don’t go walking out on your master bedroom deck in a skirt when there’s company below!

I love all the rich wood color throughout the house, including the arched bedroom ceiling. But I’m still intrigued by the seagull!

All that glass decking is going to get scratched by sand, either blowing or on shoes. Not to mention all those high gloss floors getting scratched up. But for that view, I would put up with the scratches.

There will be lots of salt corrosion, like living on a boat. But worth it, if only for a short time! I can’t imagine their insurance payments…

Shoulda built that on a lake.

I love the views of the ocean, but I would hate to live so close to it. A half a mile away with protected views would be perfect.

Why would the insurance be excessively high? They are on a 30+ foot cliff so flooding is not a problem. San Diego hasn’t had a hurricane since 1858.

You probably can’t insure for cliff erosion, which seems like the biggest risk. Those houses that are literally at the edge of the cliff are living on borrowed time.

They are on the very edge of that bluff, are the San Diego bluffs glacial till, likely to erode, or is it rock?

Sure looks like they are eroding:
