FSFA application non custodial parent

Hi!
I am a non custodial parent and do not claim my daughter on our taxes Her father does. But she wants to use our family demographic ( 1 income / 3 kids) on her FSFA application. Can she do this? Not sure and we don’t want to get in trouble.

The parent on the fafsa must be the parent with whom she lived the most in the 12 months prior to filing fafsa the first time each year. There is no other choice. Who claims her on taxes is completely irrelevant, who is custodial on a divorce agreement is irrelevant.

Right now if she has been living with her dad more than with you for the past 12 months, the demographics of that household is what matters.

If she spends one day more with you than with her dad in the 12 months before filing, she can be your dependent for the FAFSA.

Have her look at the calendar, and count days. Maybe a long weekend on your couch would be enough to push the balance into your favor.

Lucy, who does your daughter LIVE with? Tax filing status does not matter at all forr the FAFSA. The custodial parent is the one the student resided with MOST in the 12 months prior to completing the FAFSA.

Your daughter can only use YOU on the FAFSA if she has lived with you more than half, the year.
