You are correct, in a civil court it is a judgement, in a criminal it is a fine. As far as I know, sexual harassment of the kind we are talking about, either where it is something like crude jokes, sexual images or the like, or where there is some sort of quid pro quo kind of thing, is a civil offense, even if the EEOC gets involved they sue in civil court as far as I know. The only time I would assume it would be criminal would be if the boss non consensually had sex, like they tied the person up, or the person was drugged or really drunk, coercion (which is basically what sexual harassment boils down to, ie ‘do this and you will get promoted’ or ‘don’t do this, and you won’t get promoted or demoted’) I don’t think comes to the criminal level of non consent (wonder if it could be considered blackmail? )…any of the lawyers on hear know if sexual harassment outside something like I just posted, could be considered rape/sexual assault?

VERY intersting about Greta Van Susteren… tihs inquiring mind really wants to know what happened. Did she get axed and if so, why? I’ve read some speculation, but would love to know the bloody details.

I heard NPR radio speculating that she might be going with Ailes, Bannon and Trump, should they make a media company together after September.

I was surprised to see that Susan Estrich is Ailes attorney…strange bedfellows.

It is strange, but personal and business relationships can run very deep I suppose.

I was impressed with the fact that Gretchen was able to negotiate an apology from Fox and what an apology it was:

That’s pretty much an admission in my mind. It gives credence to the rumor that she or someone else had audio. I think they would have given her anything she wanted once that came to light.

Good for her. That’s probably why they settled. Hard to deny if they heard his voice.

I didn’t know anything about Gretchen Carlson before her accusations, but she’s quite an impressive woman.

I know, right??? But at least that $40M included a noncompete clause, so maybe that will prevent him creating a new media empire with a certain presidential candidate?

And he’s considering suing Fox too, along with Gabriel Sherman!

Big brass ones, that guy has. A woman would probably break her foot on them if she tried to defend herself against his advances.

To be fair, though, given that Ailes has a non-compete, he won’t be able to work for the Trump Media Corp. Nope, nope, nope. He’ll just hang around Trump a lot – maybe in his office, like, Monday through Friday. And then, surprise, surprise, he’ll find some goodies stuffed in his Christmas stocking every two weeks or so. But that won’t be anything for pay, oh no, it will just be money that Trump wants to give to an old friend. :-S

I knew he was thinking of suing NY Mag and Gabriel Sherman --that has to stem from the article on Ailes and Laurie Luhn. No surprise there, that article was a doozie – I had to take a break and pick it up again later. But personally, I think he is opening a huge can of worms if he takes that one on. Read the article yourself and see what you think.

Did not hear he was going to sue Fox. Mr. M took quite good care of his friend – Ailes didn’t pay one penny of that settlement and walked out of there with $40M. Nice deal.

I must have misinterpreted this teaser in the “Your Wednesday Briefing” email from The Times:

I guess they were referring to his suit against New York Magazine and Gabriel Sherman, not against Fox News.

(And, yes I read that Sherman article. Wow.)

Honestly, you read that article and don’t know whether to laugh or cry!
