<p>I don’t know if this is news anywhere but the NYC region. Gotti just had his fourth trial in which the jury couldn’t reach a decision and a mistrial was declared. The government is considering trying him a fifth time.</p>
<p>Has Gotti et al. been able to fix all four of the juries? Does the government really not have a strong enough case?</p>
<p>IMO, they must be fixing the juries. The government wouldn’t bring chanrges on four separate occasions if they didn’t think they had a strong case.</p>
<p>If I understand it correctly, however, the jurors are supposed to be anonymous and protected. So what’s going on?</p>
<p>If a guy is not convicted in two trial, the prosecutor should drop the case. After four mistrials, it should be clear the prosecutor is wasting everyone’s time and he should drop the case.</p>
<p>It could be general terror, just people fearing the obvious, or it could be actual manipulation of the jury, ie somebody got to someone. Remember, it only takes one stubborn juror for a mistrial. A guilty verdict requires a unanimous decision.</p>
<p>If it were 11 to 1, wouldn’t the judge know? He can poll the jurors, I believe. And if there were four trials with an 11-to-1 jury, I think that might raise some – uh – concerns.</p>
