<p>Most companies have a clause in the severance contract which stipulates no severance for “cause.” I suspect your company has such a clause and that if you are fired, they will find a reason and that you will not get severance.</p>

<p>In today’s world, when you get to a certain age, unless you are comfortable with the idea of never working again, getting fired is ill-advised. No matter what your qualifications, it is mighty difficult to get full-time employment and benefits. Contractual work, part-time work, yes - employers love you, but not a full-time gig. My guess is that VH is mostly fantasizing about getting fired. </p>

<p>Sometimes if you get wind of the fact that a layoff will be occurring, you can request a layoff and then you get the bennies/severance.</p>

<p>Non-compete is a lost cause in my state, because it cannot be structured in a way that would prevent the person from gaining employment. PhD scientists, for example, have very unique, somewhat narrowed down to one field skill sets, and it is highly unlikely for them to find jobs outside of their field (where every co can be competitor of the others). As long as one does not steal trade secrets, lure his former colleagues away and such, non-compete has little or no effect.</p>
