I really want to apply as freshman next year, but I have a forced gap year on me, (legal status etc) and I really want to takeCLEP exams and community college diploma and certificates but I am afraid it will make me a transfer… Is there anyway to take college classes without being considered freshman if you are not studying in a degree program there??? But get huge amount of credits?

No. Each place that you apply to will have its own policy about the number of college credits that will make you a transfer applicant. That means that you have to ask each of them about their policies, and if you want to guarantee your freshman status, do not take any credit classes.
If you want to keep busy, you can take classes offered in non-credit divisions of the CC. These will have names such as Continuing Education, Workforce Education, or Adult Education. Some courses might lead to a non-credit or continuing education “certificate” that can help you get a job.
Did you graduate from your foreign school? Have you had those records formally evaluated by http://www.wes.org/ or another organization that evaluates foreign credentials? If it is determined that you do not have the full equivalent of a US high school diploma, you could enroll in a public high school here even if MOWR is not available to you.
WES is kind of expensive! I can actually enroll because I can use some science courses - they were not a part of my electives under A Level matriculation - will I become eligible for MOWR then? because even if I get in college next year, I will still have 2 years ahead of me until I actually enroll (Fall 2018). The local high school counselor and I are like best buddies, so I am sure I can arrange enrollment!

Here is my advice: Pay for the WES evaluation. It will give the high school an accurate assessment of your previous studies so that you can be placed correctly in high school if you are eligible to enroll. And it will give the colleges you eventually apply to an accurate assessment of your foreign studies. In the long run, it is likely to save you a lot of headaches.
