<p>that would be willing to copy a book for me from the theological library at Emory. Here’s the situation. The book is only 88 pages. It was printed in 1891 and is now out of print. It is a biography of my great, great, great, great aunt written by her sister also my aunt. I can only find one copy that someone is willing to sell and that want way more money than I can pay. I live in Florida and the nearest University that I can find it in is the theological library at Emory. I’ve tried interlibrary loan but they won’t loan it out because it is too old although it is not in special collections, it is in the regular stacks. It is a four hour drive one way for me to go there. I would be willing to pay someone to copy it for me. Is anyone interested?</p>

<p>I don’t see a problem with copying this work. Did they even have copyright law in 1891? Copyright law is essentially civil law. Thus, if you make a copy of a protected work you could get sued, not be charged with a crime. The damages would be the diminution in the commercial value of the property. In this case, since the book, apparently an obscure biography, is out-of-print, it probably has no commercial value. If there is a copyright, it is probably passed down to the author’s heirs by the laws of descent and distribution (or by will). Since the OP is a descendant, she may actually hold the copyright for all any one knows.</p>
