Jerry Brown agrees with Betsy DeVos

Devos does not support affirmative consent laws and I highly doubt she supports keeping the preponderance standard either. Jerry Brown was responsible for signing both of those things into California law. He’s got covered what he considers the major issues so he can afford to play the “wait and see” game.

I think he is signaling he is open to negotiating on some of the procedural issues that have caused so much consternation. And it makes him look like a reasonable guy willing to hear what the current administration has to say.

So I am not sure they agree on all that much.

Well, that is an interesting interpretation of what the statement said, I will say that.

The California law on affirmative consent is vague. It will take lawsuits and appeals before we have the necessary case law to understand what it means.

DeVos: We’re rolling back relatively loose regulations.
Brown: We’re not adding yet more regulations (and we already have about the most progressive laws in the country).

There is nothing in here that says they’re in any kind of broad-strokes agreement.

Except that they are both saying directly that the current system fails to uphold due process. And that this is an area where we should move carefully, rather than just ramming stuff through. But yeah, if you ignore those two pretty big things, there is nothing that says there is any kind if agreement.

Picking one point is a long way from being able to say they “agree” on broader issues. As he says, “This isn’t not a simple issue.” The thread title misleads.

You guys are working too hard. They agree on the salient point, that the Title IX guidance and system built in the last administration needs to be addressed because it fails to protect due process. How much of the detail they agree on, who knows. Because they also agree that the area requires study and thought.

It is ok to admit that on some things a progressive governor can agree with a cabinet member in a republican administration. No one will pull your subscription to Mother Jones or the NYT, I promise.
