The law presumes that the lawyer had strategic reasons for not using a witness – Syed’s lawyer has the burden to prove otherwise. The trial lawyer had a private investigator and 4 law clerks working on the case-- but the post-conviction relief lawyer chose not to call any of them to testify at the 2012 hearing.
Opinions of the new development?
"Adnan Syed, whose murder conviction became the subject of popular long-form radio show “Serial,” will be allowed to introduce new evidence, a Maryland judge ordered Friday.
Baltimore City Circuit Court Judge Martin Welch ordered that Syed’s post-conviction proceedings would be re-opened ‘in the interests of justice for all parties.’”
Will be watching with interest.
Is anyone watching Undisclosed? I’m fascinated by this podcast. Can’t wait to see what their thoughts are. But I am positive that they are over the moon
Deb, I have listened to a couple of episodes. I thought I was way behind on it - are they still developing new episodes??
Yes! Undisclosed is a much deeper look into the case than Serial. Highly recommend, if you enjoyed Serial.
Still new episodes of Undisclosed. Last week they talked about Adnan’s original attorney.
^ Thanks for this! I actually figured out how to get podcast from my phone to play on the car speakers via bluetooth…have some long driving days ahead and now have something interesting to listen to in the car. I listened to the first few minutes today and found it very well done, circumspect and interesting considering these are lawyer bloggers, not professional journalists.
^^This is what I do. Before a road trip, I’m all hooked up in the car - the iPhone holder on the vent, the power into the iPhone to keep it charged the Bluetooth or the audio plug to hear it well. Works GREAT!!!
First episode of Season 2 is up! Haven’t listened yet.
woo hoo -Thanks!
I’m not as excited about this one, but a friend already has listened and she swears that I’ll like it.
It’s eye opening. There is a lot of information that they were able to find that wasn’t in Serial. The flimsiness - that’s being generous - of the case that put a 17-year-old student away for the rest of his life is shocking. The defense could have made huge, irreparable holes in the state’s timeline and medical evidence, not to mention perjured testimony, with minimal additional checking and effort. It is scary how much harm it appears can be done simply by choosing the wrong attorney.
I predict Adnan will be granted a new trial, and that with the presentation of the new evidence, he eventually will be freed. I would hope the two Baltimore detectives in this case are then the targets of civil suits, as they have been for unethical conduct related to other cases.
Oh it just occurred to me @Youdon’tsay that you are probably talking about season 2 of Serial (I was referring to Undisclosed).
I agree, not too interested in the subject.
I wasn’t that interested in the subject if Season 2 either, but I just listened to the first episode and it is pretty compelling.
That’s good to know, nottelling. I started it, but will finish it tomorrow. The first 10 minutes really piqued my interest.
I am listening to Undisclosed. Episode 3 about Jay. If the attorneys involved in this show are correct, heads are going to role. Adnan is going to go free. What a miscarriage of justice.
@dstark wait until you get to the medical evidence.
What I still don’t get is Jay’s motivation for spinning tales out of whole cloth, but his admitted lies are almos tangential once you learn about all the other mistakes and omissions.
They aren’t.
^ Do tell?
