<p>NYU Faculty Against the Sexton Plan (FASP) and community groups prevailed in court yesterday. At issue are the four tracts of land that were assigned to the Department of Transportation following the cancellation 50 years ago of the Lower Manhattan Expressway. These ‘strips’ have since been used as parks for more than 50 years. NYU and the City claim these strips are not parks; FASP and the community, backed by the affidavit of former Parks Commissioner Henry Stern say these strips, bounding the proposed expansion site, were long considered parks by the Parks Department and would have been formally transferred to the department except for NYU’s objections over the years. Indeed, the Parks Department has held opening ceremonies, posted rules and even named parts of these strips. If indeed they are legally found to be parks, then only the State legislature can transfer them to NYU. Preserving these strips as parks, which the community has long sought to do, would force significant revisions to NYU’s expansion plan, known as NYU 2031.</p>
