Patents at University

I have been working on developing a patent-able innovation for the last year. I’m not ready to file yet so I hope to take the idea with at my university and further develop it there in an undergraduate research. Based on what I’ve looked at and read its very difficult to keep a university off your back if you do any work through the school or use any of the schools resources they can often take hold of part of the patent and receive part of the revenue that’s generated. Anyone know any loop holes or ways around things like this? I feel as if i should be able to study under the university but get all the patent as its my idea and I’ve developed most of it before attending the school.

If you use the university’s resources you are going to be hard pressed to argue that they don’t have some rights in the invention. The only way to get around this is to have them enter into a contract that specifies that you are the only one to hold rights in the patent. It is unlikely they would agree to that, however. You need to get a lawyer to help you negotiate this.
