<p>I work at a Big 10 school, and deal with our attorneys frequently as do many faculty, staff, and administrators. I was stunned when I found out that until recently PSU lacked in-house counsel. I have been told that they are not yet fully staffed.</p>

<p>The relationships are clear. The money flow is already established. The child sex trafficking (the appearance at the Alamo Bowl) is already established. What role Courtney had in it is speculation - and we’ll never know, will we? Because it is protected by attorney-client privilege: Courtney-Joe Pa, Courtney-Football Program, Courtney-Second Mile, Courtney-Penn State.</p>

<p>It is mindboggling to me also that PennState does not have better legal advice. They seem incredibly isolated and unaware of the world outside Happy Valley.</p>
<p>It’s startling that any organization of the size and complexity of a major university would not have a Legal Department. But not surprising in this case – they’d never needed one. Who in Happy Valley would have the gall to sue Penn State? What law enforcement agency in Happy Valley would have the gall to arrest someone important to the university? Crimes committed by football players were handled “internally.” Investigations of Sandusky in 1994 and 1998 quietly went away. A District Attorney mysteriously disappears, a hard drive is destroyed. A pedophile’s actions are swept under the rug for decades. When you have that kind of power to intimidate prosecutors, witnesses and complainants – why bother with a Legal Department?</p>
<p>^great points LasMa–and that they didn’t follow the Clery Act requirements, is mind boggling. This and the fact that Penn State is not further investigating/disciplining Spanier is sickening. As president he should have personal and professional consequences to his inactions, and cover up, and frankly it is ironic to me, that football (while clearly a huge part of the problem at Penn State) has taken such a hit, while the administration remain largely untouched by Penn State.</p>
<p>Las and Myturn, I agree. It is mindboggling, reading the student newspaper, that they think that PSU is the most ethical school, and that they say they will be the leader in Clery Act reporting, because they are the only school with a dedicated Clery Act reporter, totally ignoring or oblivous to the fact that most schools have had legal staff dealing with these issues for years. </p>
<p>It’s time for the Board of Trustees and the Faculty Senate to say we are a great school, and football is a tiny.tiny piece.</p>

<p>At this point, these postings seem to be mostly conjecture, and extrapolation of the facts. If this is the primary purpose of these postings, I retract my statement as it would have been made in ignorance.</p>

<p>Spanier insists when an assistant football coach reported seeing Sandusky acting suspiciously with a boy in the team showers in 2001, he was only made aware that Sandusky had engaged in “horseplay” with a child.
“Never in my time as president of Penn State did I ever receive a report or even a hint that Jerry Sandusky was engaged in child abuse, a sexual act, criminal activity or anything resembling that with any child. Had I known that, or even suspected it, I would have forcefully intervened. But I never heard a report like that,” he said.

<p>I continue to be astounded that Spanier, a university president is claiming “he was only made aware of horseplay”. Aside from what is obvious, that McQueary wouldn’t have been so distressed by horseplay, and that Spanier himself said they could be vulnerable for not reporting, but as the president it was his responsibility to understand exactly what was observed by the witness bringing the information forward. It was his responsibility to ask for clarification if something was unclear. Seriously, even if the term horseplay was used, (which I don’t believe) how could anyone consider the term horseplay an acceptable description. what does it mean anyway? Why isn’t there an uproar at Penn State about Spanier’s bs? In my view it was his inaction that has brought all this damage to the university. He could have overruled Paterno, if he had any basic sense of right and wrong.</p>

<p>watching Spanier, omg–he actually says, I was told horseplay, it conjured up things from my childhood, like snapping towels in a shower. But I didn’t ask about it…</p>

<p>he also stated, that they agreed to talk with Sandusky, and that the response they got back after Curley spoke with Sandusky is that Sandusky got the message, and would cooperate. huh??? it had been reported that Sandusky completely denied it to Curley, and stated “it didn’t happen” how could that be interpreted as Sandusky getting it??? lots of holes in his story…
And I remember asking two questions. “Are you sure that’s how it was described to you, as ‘horsing around’?” And the answer was yes from both Gary and Tim. And, “Are you sure that’s all that was said to you?” And the answer was yes. I remember, for a moment, sort of figuratively scratching our heads and thinking about what’s an appropriate way to follow up on “horsing around.” I had never gotten a report like that before.2</p>

<p>And yet in his email to Curley, he talks about the university’s “vulnerabilities” and (before Paterno vetoed it) had apparently signed off on a plan to turn Sandusky over to the authorities. Hard to reconcile those things with horseplay and towel-snapping.</p>
