Penn State Sandusky scandal

<p>What has happened here is that Governor Corbett has gotten some indication from attorneys and others, that there is a chance that the NCAA overstepped their authorities and that some of the penalities and other sanctions might be mitagated through some negotiations. Whether he is on the mark about this, or delusional, and/or had bad advice remains to be seen. I doubt very much that Corbett just decided to make this charge all on his own.</p>

<p>PA has a disturbing habit of routinely re-electing its governors no matter what, so I question if that is Corbett’s motive. As a former state AG his sudden questioning of the validity of the NCAA sanctions is a puzzle; it seems to me that if really thought it was an issue it would have been raised before PSU accepted the deal.</p>

<p>I am also curious to see how PA can have standing to challenge this. (This is something that I know from personal experience is covered in first year law school classes, so…) PA is not a member of the NCAA, nor a party to any contract with it (as far as I know); I am not aware of any duty the NCAA has to PA, etc. </p>

<p>As a PA taxpayer, my head will officially explode if I learn that Corbett has hired an outside law firm to take this case, though.</p>

<p>The NCAA has very broad authority that includes institutional governance related in any way to athletics.</p>

<p>I think this latest move will create more negative publicity and as a result you’ll see obrien leave.</p>

<p>In essence, that’s exactly what some people have said.</p>

<p>The NCAA deserves this kind of bogus lawsuit. The price they pay for having no spine nor clue. Had they imposed the only penalty that was warranted, there would be only discussions about reducing the death penalty. </p>

<p>The fact that football was not only played but shown on television remains the biggest injustice in this sordid case.</p>

<p>But Corbett’s suit has exposed the lie of that acceptance, a university board of too many sports sycophant fat cats who never got it and never will, complaining about persecution like stuck pigs. Penn State is not a party to the suit, and some may take it as a sign of maintaining distance, but that’s a misread. As a state-related institution, the university receives funding from the government of Pennsylvania. Corbett himself is an influential member of the board. In filing suit, Corbett is the university’s front man and the university his silent partner.</p>

<p>So Corbett continues to be tone deaf about how his suit further besmirches Penn State. He just cares about ingratiating himself with donors and alumni for his reelection run. Where’s he getting the money for the outside counsel he hired to bring the suit? I just hope newly elected AG Kane pursues all the leads in finding out how this got swept under the investigative rug for so long.</p>

<p>Not sure I see how this suit helps Penn State very much. In fact in terms of headlines and public perceptions it kinda picks the scab off of an ugly wound that was slowly healing. Now it puts “Penn State = Child Rape” back in the public mind. The upcoming trials of Spanier, et al. were going to do that well enough on their own. No need for another lawsuit to do it also.</p>

<p>Plus, if he really is fronting for Penn State, then it is Penn State that is tone deaf more than the governor. They are already trying to live down a badly tarnished reputation; why make it worse? Why add “backing out on deal they already agreed to” to the long list of perceived misdeeds by the school’s leaders?</p>

<p>Of course, I have no inside info, but it seems like he’s doing this to cover his own butt for re-election. I don’t think Penn State is a silent partner at all. And from the various PSU fb pages and blog comments I see, most alumni still think he’s full of *****.</p>

<p>And the article that talks about how the university gets state funds … Again, 7% of their budget comes from the state. Corbett has slashed their budget and would have slashed it even more last year, but it didn’t pass. He doesn’t care about PSU at all, except for how they affect his career.</p>

<p>Tellingly, the suit was filed without the input of the state’s incoming attorney general, Kathleen Kane (D). Ms. Kane ran on a promise to examine Mr. Corbett’s handling of the Sandusky case, which he began investigating as attorney general in 2008.</p>

<p>hope the suit compels Kane to pursue Corbett even more vigorously. Corbett’s belief that PSU should not have sanctions demonstrates the very behavior that permitted Sandusky to victimize so many for so long.</p>

<p>I wonder how voters will feel when they find out how much of their taxpayer money is going to pay for the suit, which is not likely to succeed.</p>

<p>^I’m sure Corbett campaign has done proper internal polling and group study before he launched the suit, so the subsequent polling result should not come as a surprise.</p>

<p>Just saw a news item that Al Pacino will be playing Paterno in Brian DePalma’s upcoming movie “Happy Valley”.</p>
