Seems to me the victims could bring a conspiracy charge against them. (Disclosure: All of my legal expertise comes from watching hours of Law & Order :rolleyes: )</p>
<p>From the grand jury report it is clear that Schultz and Spanier were aware of not only the 2002 incident observed by the grad assist but also the 1998 incident and the incident in the fall of 2000 reported by the janitor.

<p>Agree with Tom1994 post #140. Paterno is not going to do or say anything that undermines the image of the Attorney General. In my job I read enough indictments and peruse information about prosecutorial investigations to know that when a key actor in the drama has not been charged, even though his or her actions might be questionable or even culpable, that person is almost always is fully cooperating with the prosecution [often as the result of non-prosecution arrangement]. The case ends with convictions of the perpetrators and the "unindicted’ folks resume their lives as usual.</p>

I also wonder if Paterno is an important witness for the prosecution will the DA’s office make a public statement of some type that is supportive of Paterno’s actions thus rebuilding his reputation. I can not imagine the prosecutions case is helped by tarnishing Paterno.</p>

<p>Child Protective Services were not informed or there would have been an investigation. It’s not simply a timeline issue.</p>

<p>I am just learning about all of this; it is absolutely heartbreaking and shameful. I agree this will be Paterno’s last season (and I hope the end of the campaign to name the stadium after him). I think Spanier should also go. The Board of Trustees will be meeting on Friday.</p>
<p>I don’t understand why some feel the “grad student” should get a pass. This was Mike McQueary, who is still on the coaching staff; you don’t think he was protecting his own interests? At the very least, his days as recruiting coordinator are over.</p>

<p>I think Mike McQueary should get a pass because at least he DID report it - calling Paterno at home on a Saturday morning. According to several of the victims statements in the grand jury report. Others had seen Sandusky showering with them. The victims did not know who had observed them . just that someone had seen them in the shower w/ Sandusky. It is inconceivable that by 2002 everyone connected w/ PSUs athletic depart didnt know about Sanduskys proclivities.</p>
