Sentenced to 30 days in county jail

If that’s all his sentence is, he got off pretty darn easy.

In theory, yes! In practice, he will need ICE to look the other way, which is extremely unlikely.

If he is not a citizen, isn’t that automatic deportation for this kind of crime with conviction?

Wow, 30 days. I can’t presume to know what the proper puishment really should be but really 30 days? Sad.

Stunned. Just stunned. Bet this will be the topic of conversation on NJ101.5 today.

The judge’s words appear balanced:

“The word hate has never crossed my lips nor Ms. McClure’s. This individual was not convicted of a hate crime. he was convicted of a bias crime and there’s a difference. I do not believe he hated Tyler Clementi. He had no reason to. But I do believe that he acted out of colossal insensitivity.”

I’m going to catch a lot of flack here, but I think it’s the most he should have gotten (the court itself offered no jail time at the start, so maybe it’s not so off-base.)

First of all, if the papers hadn’t wrongly reported what went on, everyone’s opinions would have been different at the start. Secondly, we have no idea why Clementi killed himself; it’s very sad, but there was a lot going on in his life.

third, the “bullying” went both ways. If Ravi had killed himself over Clementi’s prejudicial Indian remarks, would that have made Clementi guilty? of course not. They were both barely adult, making the kind of remarks kids do when they should know better.

If an Indian-American gets beaten to death in New Jersey, what sentence does one of the defendants get? No jail time.[Family of Old Bridge beating victim ‘devastated’ after defendant is cleared of major charges | NJ.com](Family of Old Bridge beating victim 'devastated' after defendant is cleared of major charges - nj.com)

This case was overblown from the start. Real bullying takes place all the time, and we have a good law in nj to deal with it. This case was something else. Even many GLBT activists recognized it, once the actual facts and not the made-up original story, became known, and have spoken out against jail time.

Great post Garland. I couldn’t agree more.

I won’t get into the ‘bullying’ aspect that may or may not have caused Clementi’s decision…But, Ravi was also charged with witness tampering, obstruction of justice, destroyng evidence, and just these charges would make him deserve some jail time

Wow, that’s a light sentence. The judge had harsh words for the defendant, but a light sentence. I don’t get it.

Ditto #9…

Qdog–or the court was guilty of piling it on–the charges were ridiculous and overblown from the start–giving into a mass hysteria ( and again, the court offered no jail time in a plea bargain, so again, it may not have felt the charges warranted it.)

What gives garland? Guilty is “overblown”?

Because first of all, we don’t know what pain he caused. I think it is comforting to Tyler’s family to have someone to blame, but we just have no way to know there’s a connection.

And so if he really did not feel bias (which he’s always maintained), and there’s no way for him to know why Tyler did what he did, why would he apologize? I wouldn’t.

He could apologize for being a jerk, cuz it sounds like he’s a bit of one, but if that were ahanging offense, this country would get awful empty.

I thought those remarks from the judge were a little misplaced because Ravi didn’t speak at all, only to enter his plea and to decline to testify. I haven’t watched the whole video of the judge’s decision but I did think he did a good job of not playing to the camera. The media attention was a problem in this case from the start.

Even jerks have the right to expect the justice system to work

So true. Sadly jerks and others less lily white people often find justice less than blind.

Exactly. And relative newcomers seem to get the least–I’m reeling over that beating case I referenced above, which got zero attention out of the area.
