For my state, montana, the residen requirement is to be domiciled in Montana for 12 months in a row…

“For the purposes of higher education, a student must be domiciled in Montana for one year immediately preceding registration. Attendance as a full-time student is not sufficient to qualify for residence. For more information, see Montana Codes Annotated 20-25-201”

Now, I live at my brother’s house and I Help him out with food and rent. I have been physically in Oregon though from 01-2009- 08-2009. Does that mean I have to be here until 08-2010 to qualify for residency?

You need to speak directly with the admissions office(s) in Montana about this. Are you old enough to be independent of your parent(s) for financial aid and residence purposes? If not, is your brother your legal guardian? Was Montana your residence before moving to Oregon? All of those factors could affect the date when your in-state status becomes fully effective. Only someone at the institution that you hope to attend can give you a clear answer.

Not clear on situation. Are your parents in Oregon and still claim you as a dependent or contribute to your living expenses or will be contributing to your college costs? In that case, you would likely still be a resident of Oregon for college purposes and staying with your brother doesn’t change that even you do so for a year. If you have become a true independent beginning August 1, 2009 (and you may have to prove that by showing you support yourself and proving your parents are providing no support and don’t claim you as a dependent), and have been living in Montana since then and continue to do so, then you can possibly qualify as a resident by August 1, 2010 which under Montana’s rule would allow you to pay residence tuition for fall 2010 because you don’t have to register until August 2010 even if admitted for the fall term before then.
