Roommate, privacy issue

So basically I wanted to know if it was illegal for him to record me in our room or is it illegal if I record him in our room when we are talking, btw we dont know if were recording or not.

Varies by jurisdiction I believe. Check local laws. Laws aside, I think its morally and ethically wrong.

I live in new york state and would like to double check with people in case so i would like to know if it is legal by law

thanks, i really needed this

Depends. But even if it’s technically legal, it’s really creepy.

I know don’t know why you are doing this and I don’t really want to know. But, my advice is regardless of the particular law in your jurisdiction that you get permission (in writing or taped) of what you are doing.

What’s the deal? Why would you and yoir roommate be taping each other…at all.

Just don’t.

It’s probably against university housing code ; check with them

I don’t know your state’s laws, but if you are in the dorms, many university housing offices have a strict code of conduct that you sign when you initially sign their contract. I’m not a lawyer and cannot give legal advice, but I will tell you what I’d tell my kids… If you discover that you have been recorded, you need to talk with your RA/the housing coordinator for your dorm and your parents ASAP before anything else is done to escalate the situation (by either you or your roommate). For my kids’ dorms, this is grounds for severe disciplinary actions/eviction. Even if you thought you were recorded but weren’t, you need to talk to your RA, counselor, or someone that can help you resolve any issues between you and your roommate.

In NJ, it ended up being a big deal when one student recorded his roommate using a webcam. http://abcnews.go.com/US/rutgers-trial-dharun-ravi-sentenced-30-days-jail/story?id=16394014

In some states, it’s permissible. However, if this is a trust issue, why go through the hassle? Meet w/your RA or housing director and get the heck out of Dodge.

That awful Rutgers situation was devastatingly tragic.

If the situation has gotten to the point were you have to record each other it is best to contact your RA and part ways.
