I was wondering if someone could be considered a thief if they took property which was obviously abandoned. Especially if it was in or near a dumpster/garbage can.

In practice, anything in or near a dumpster/garbage can tended in practice to be considered abandoned property. Thus, someone taking it wouldn’t usually be considered a thief.
