Student with Question Regarding Non-Resident NY Taxes

<p>I was hoping that one of the parents who understand taxes might answer a question…</p>

<p>I am currently a 22-year-old senior at Juilliard, having lived in Manhattan for 330 days (end of Junior year, part of summer, start of senior year) during 2011 as a non-resident. My home state is Washington (no income tax). </p>

<p>In 2011, while attending school, I earned $17,592.00.</p>

<p>I am filing both my federal and NY taxes using the free version of the online TurboTax. My federal taxes made sense, but it seems like the NY tax is high:
AGI: $17,592
Standard Deduction: -$3,000
Amount taxed by NY: $14,592
Taxes Owed: $653</p>

<p>Could the taxed owed amount of $653 be correct for a non-resident? What does the New York Income Factor of 1.0000 mean? There was a question asking if I maintained a NY residence for over 185 days. I answered yes. Did the fact that I lived there for 330 days make me a resident, thus having me pay a higher tax? Should I have answered no…since I am a student and students are exempted from residency? </p>

<p>The purpose of the nonresident NYS tax form IT203 is to insure that you only pay NYS taxes for the portion of income earned in NYS. The NYS income factor of 1.0 means that you earned 100% of your income in NYS, which means that you must pay state taxes on the full amount. The income factor is determined by dividing your NYS income by your federal income. </p>

<p>Using your numbers I calculated your NYS taxes by hand (IT 203), and the number is unfortunately correct. Since it appears that all of your income was from NYS your state taxes are the same as a new york state resident (I also filled out the resident form to compare)</p>

<p>The number of days in residency would not have made a difference in this instance.</p>
