Terrible! and Depressing!! Situation at home :( :'(

<p>First of all, Happy Independence Day!
They’re so right when they say that when problems arrive, they arrive in bundles.My maternal grandfather is almost on his death bed and he has become far from us,more than we could have ever imagined.
My parents lived in the US for about 6 years on green cards.
They even had applied for citizenship but unfortunately due to personal reasons,we all came back to settle down and start afresh in India(1998) leaving behind most of our relatives behind in the US.
We never had any plans of visiting America because of our poor financial situation and never paid heed to our expired green cards.
We surrendered them and requested a visitor’s visa, were interviewed and told that we should wait for about a few weeks.It has been 47 weeks and they still have our passports lying at the embassy.
We’ve tried emails but they don’t give a firm response.They keep on saying it’s under admin-processing.</p>

<p>This is what they reply => Your application is pending under Section 221(g) of the Immigration and Nationality Act (INA) for mandatory administrative processing. There is no definite time frame for this processing as it depends on the individual circumstances of each case.</p>

<p>Now, this is our’circumstance’.Any advice? and when I say any I literally mean it.Any advice on how to go about this predicament ?
I am a US citizen but cannot sponsor till I’m 21. With all these college apps and all, when I see my mother sob and break down, it’s hard and bitter for ALL OF US to work together in this so very important stages of our lives.</p>

<p>Are you saying that your grandfather is ill and dying in the US? As you are a citizen, is it possible that you can travel alone to the US to see him? I understand how much your mom would want to be with her father, but it seems to me that one family member coming to see him is better than none.</p>

<p>A good immigration attorney is expensive but may be able to help figure out if there is a way to speed things up. Have heard this from several friends recently who were mired in immigration and visa hassles.</p>

<p>The section you cite is simply the one that allows a visa to be refused for failure to qualify. The article linked below discusses some reasons why a 221(g) refusal may occur, but since no action has been taken on your family’s visas one way or the other, I don’t think the information is very useful. The only possibility I can think of is that your family members’ having obtained green cards once before may have raised suspicions that they have changed their minds again and this time will overstay their visas to remain the US. But that doesn’t explain the lengthy delay. However, at the end of the day, no alien has a right to enter the US, and the risk of not being allowed back was one your family took when they left.</p>

<p>The Congressman in the district where your Grandparents live would be the appropriate legislative official to contact. They often interceed with the Federal government on behalf of their constituents.</p>

<p>Is it possible because your parents did not file US income tax while holding green cards and working in India?
Do you have any documents from doctors showing that your grandpa is terminally ill? This will help for visa reapplying.</p>
