<p>You shouldn’t need to violate the Constitution if you go about things the right way. The Constitution is flexible (only 27 amendments in 200+ years). Amend the Constitution if need be, but don’t go around it.</p>

This question is a little too open-ended. At the same time, the issue of “power” to fight “terrorism” becomes very complex before we can even consider the question. What exactly is power? Is power the ability to detain, search, incarcerate and execute? Is power the ability to lie and influence others? Is power the ability to disregard the opinions of the other “co-signers” of the Lockean social contract? Or is power, simply and fundamentally, the ability to dole out life and death?</p></li>

<p>And if that wasn’t complicated enough, I think you can probably guess how complex the question of “what is terrorism” is.</p>

No - the basic foundation of a civil society in the form of a republic is rule of law. This could get into a very long discussion of the evolution of Western political thought, but I need to eat dinner and I’ll suffice to say that, in a republic, laws are NOT made to be broken.</li>
