Suspect is charged with “two counts of aggravated murder, attempted aggravated murder, first-degree assault, three counts of unlawful use of a weapon and two counts of intimidation.”
I don’t see any hate crimes in that list. The charge is “aggravated murder” because he murdered two people.
@zobroward:
It would be nice if you actually read the links you post. In the Oklahoma case the defendant pled guilty to the charges,which basically means there was a plea deal there and hate crimes didn’t get involved, plus the defendent likely may be mentally ill, which would rule out a hate crime (if you commit a hate crime you have to be mentally responsible and know it was wrong).
In the second attack the cops attribute the motive to robbery and are saying his claims are a smoke screen to hide the true reason, trying to make it look noble or something. personally, if the guy shot the kid because he wanted to kill non Muslim’s like that, he should be charged as a terrorist, the penalties are a lot stiffer than a mere hate crime.
With a hate crime you can’t just charge someone let’s say who is black who kills a white person, or a born again Christian type who kills a gay person, with a hate crime on the assumption that was the motive, in hate crimes the prosecution has to prove not only that the defendent held biased thoughts against the group in question the victim belonged to (or apparently did, as for example when morons in this country killed Sikhs assuming someone in a Turban was muslim, and most of the perps in those cases were not charged with hate crimes), but that he/she actively acted on that, for example if some moron and his equally dimwitted buddies are in a bar and the guy leaves, saying “I’m gonna go get me a Muslim” and is arrested for attempting to beat up or kill someone who is Muslim, he could be charged (obviously, a slam dunk would be if the guy went after the person he perceived as being muslim and said something like “gonna send you to allah, this is for 9/11” or whatnot). The myth is the crime just has to be where the perp is a different race than the victim or some kind of difference, or that if someone let’s say is a white supremacist and kills a black guy they can just assume that is the motive, they have to prove it, and the burden is pretty high.
What I love about hate crime discussions is where i hear “how come other groups aren’t charged with hate crimes for killing a white person”, when statistics show all over the place that a white convicted of killing someone of a different race often faces lesser penalties than a black person let’s say for killing a white person (depends on the jurisdiction, some places the disparity is huge, in others not so much). Crimes against minority groups that are not necessarily hate crimes in motive often have less penalty associated with them.
I do read and i do not use selective info or “facts” to fit my agenda… I am not sure where you came up with those alternate facts
. using that logic the killer in portland motive is questionable and he has a high % chance he will be found mentally ill.so why the calls for the d of j to file hate crime charges.
The black man who gutted a white student at u of Texas was probably a hate crime too…but not enough info has been released on that rampage yet. …(unlike portland)So i left that one out.Along with several other recent cases…including the 8 month old white girl who was tortured and murded by a black woman in maryland.
