UK Tier 2 visa question-immigration attorney help

I know this is a stretch, but maybe someone here knows the answer. My daughter is in the UK on a Tier 2 Intra Company Transfer visa. She has the opportunity at a job at another company, but has been getting conflicting reports about whether she can indeed change the sponsorship of her work visa. Some have said she has to come back to the US and reapply for a new visa from here; others have said since the job title is the same, she should be able to just notify the Boarder Agency of a change of employment. It is hard to tell from the UK Boarder Agency site if a cooling off period (which we think is one year) is required or not in this circumstance.

It is my understanding that she has spoken with an immigration law firm that specializes in corporate immigration, but there was a conflict of interest since this was the company that helped process her current visa. The new company is looking into this, and hopefully they will have a work around, although I am not hopefully. If there is indeed a cooling off period, my daughter believes it is a year that she will have to work in the US; again, conflicting reports.

Might anyone here have some experience in work visas, either personally or professionally? While my daughter is happy to hire someone to give her a definite answer, it is her hope the new company will be able to handle this on their own.

Well my daughter received the answer, and not the one she was hoping :frowning: She is required to spend 12 months in the US before applying for another Tier 2 ICT visa. The new company is going to see what they can do about her offer as far as whether she can do the same job in the US, or possibly another job. Then she has to decide if she wants to accept. As her goal was to stay in London, this is not the outcome she was hoping for. She knew dealing with visas was never going to be easy, but also didn’t expect to return to the states so soon.
