Scalia and Santorum should quit their day jobs and just become internet trolls (although I concede that Santorum’s views, while not my own, are sincerely held )

Cried today with a member of my church. When the Feds recognized marriage we made plans for his partner and he and I to travel to Delaware so they could marry. Charley died before we could get the license. 65 years together. Rejoicing today but tears for what might have been.

There’s some talk about a really startling paragraph from Thomas’ dissent. I wonder if any lawyers can comment in layman’s terms on his legal basis for this part of his dissent. Is he just being particularly nuanced and saying something like protection of “dignity” is not a constitutional right? Or is this just as nutty as it sounds, particularly coming from an African American judge?

"The corollary of that principle is that human dignity cannot be taken away by the government. Slaves did not lose their dignity (any more than they lost their humanity) because the government allowed them to be enslaved. Those held in internment camps did not lose their dignity because the government confined them,” Thomas wrote. “And those denied governmental benefits certainly do not lose their dignity because the government denies them those benefits. The government cannot bestow dignity, and it cannot take it away.”

My 12-year-old ran herself out of rainbow duct tape this morning in celebration.

I am not a lawyer but the paragraph that @anomander posts is appalling to me. I don’t think you need a JD to understand it. Being forced to be a slave does not take away your dignity??? Being put in a camp and rights taken away does not mean treating you as something "less"than others?

great news!! Attitudes have evolved quickly (finally!) on this over the past few years - even here at CC. When NY legalized same sex marriage a few years back, threads about it were deleted.

I haven’t seen any quotes from Alito, but Scalia’s is an instant classic. Almost as awesome as “jiggery pokery.”

In relation to what Thomas wrote, there are several definitions of dignity. One is: “the state or quality of being worthy of honor or respect.” Another is: “a sense of pride in oneself; self-respect.” For what it’s worth, I think Thomas is referring to the latter meaning, i.e., that no outside person or entity can take that away.

He conveniently ignores the first definition, which is of course the connotation for most people.

I was just sitting in McDonald’s and an elderly man sat at table by me and looked at the TV screen and started weeping. He fell in love 50 years ago but they parted for fear of being arrested. Just told me he never stopped thinking about him and has been alone all these years.
