What counts as rape?

<p>Well if the woman can show up, look innocent, may’ve cry a little and accuse you then good luck proving it was consensual</p>

<p>What if both people have had drinks? Can a girl claim she was raped because she was drunk and had sex if the guy was drunk too? If that’s true why can’t it work the other way, like if a girl claims she was raped because both were drinking, can’t the guy also claim rape?</p>

The legal system is sexist in several ways.</p>

<p>Wow…that law seems a little harsh. Leave it to NC though. Here they don’t even allow a divorce if the guy is beating the crap out of his wife…</p>

<p>Trust me…I found it hard to believe also. A friend of mine went through divorce and I helped her with the paperwork…don’t worry, she wasn’t being beaten. One year and one day separation or legally declared insanity is the only way to get a divorce in NC. Family values…yeah I guess so. Seems backwards to me. Getting slapped around doesn’t sound like a good value to add to a family, particularly if children are involved. I think the detriment little Bobby would experience from seeing daddy smack the crap out of mommy would be ten times worse than the detriment of divorce.</p>

<p>I was thinking the penalty for actual rape should be castration on top of jail but that would only work if there were no false rape accusations. It would be similar to the death penalty. I feel in some cases it might be justifiable if the crimes are severe enough but its not worth the risk of ending an innocent life. I feel so bad thinking about the people who were given the death penalty but were later proven innocent.</p>

<p>Sadly this has been the case at another UNC campus in 2012 as well. Young men in NC are in a very serious situation on campus. There is no time limit in which the female is required to file complaint. Even if witnesses can attest there was no rape, a single administrator can determine young man’s fate. Regardless of his record the odds are if alcohol is involved the male will be found responsible. Beware it is devastating. What are the odds of these men getting into grad school after being suspended for this charge?</p>

<p>^ I mean you are probably ■■■■■ and I am not sure why I am even responding to this but ehm you know what you are doing right there is rape apologism & Victim Blaming at its finest.
All too often if a man is found guilty of rape he gets the benefit of the doubt and the victim gets the blame for ruining his future.</p>

<p>^ Actually, I don’t think he/she is victim blaming at all. I’m a survivor and unfortunately I know all about victim blaming (hell, I was blamed and I wasn’t even a teenager yet when it happened!). </p>

<p>However, the truth is that a lot of women <em>do</em> make false accusations (they regret the sex later, they’re bitter, etc) and they are truly the scum of the earth because THEY are the reason that TRUE survivors are looked upon with suspicion. And it truly can be devastating to the men who have to go through the accusations when they are false. Once someone accuses you, that cloud of suspicion almost never goes away. If there is no physical evidence, no witnesses, etc then the whim of an administrator should not be enough to condemn someone. It’s just too big of an accusation to make on nothing.</p>

<p>Well, people on here sure do misunderstand their own states laws’ and our entire country’s legal system. </p>

<p>Does anyone know if the North Carolina laws and UNC policies protects men who say they have been raped by a woman equally? </p>

<p>If a man was drunk, and a sober woman sexes him, and the man claims that he was raped once he is on longer drunk, would the law equally be applied? Is there a time limit for men to file a complaint of being raped? Suppose alcohol is involved. </p>

<p>If there is a double standard then this is a lawsuit waiting to happen and I hope a male rape victim cashes in with a lot of money.</p>
