What should I do if I don't have a Visa, but I'm also not a citizen? [advanced parole]

Hi, I’m here on Advanced Parole currently, and have an EAD, and a SSN. I’ve lived in America for 17 years. In commonapp there’s no section for someone with a situtation similar to mines, I don’t need a visa and I’m expected to get a green card within the next 2 years(Before I turn 21). I feel like saying I have no visa and don’t plan on applying for one makes me sound like an undocumented citizen which might hurt my application, what should I do?

I assume you are a senior in HS?

You should contact each college on your list and ask an admissions staffer how to handle this. Start with your in-state publics and go from there. Some states will give students in your situation (graduating from in-state HS) in-state tuition rates, others won’t. I expect most schools will tell you to check citizen of non-US country on the common app, and explain your situation in the additional info section….but talk with each school first. Good luck.

The student is most likely not eligible for federal aid. According to this link, Advanced Parolees are never considered potentially eligible for federal student aid:
U.S. Citizenship & Eligible Noncitizens | 2024-2025 Federal Student Aid Handbook. Click on U.S. Citizenship & Eligible Noncitizens, then on U.S. Citizenship & Eligible Categories.

Here are the categories eligible for aid:

Eligible Noncitizen

A U.S. national (includes natives of American Samoa or Swains Island), U.S. permanent resident (who has an I-151, I-551 or I-551C [Permanent Resident Card]), or an individual who has an Arrival-Departure Record (I-94) from U.S. Citizenship and Immigration Services (USCIS) showing one of the following designations:

  • “Refugee”

  • “Asylum Granted”

  • “Cuban-Haitian Entrant (Status Pending)”

  • “Conditional Entrant” (valid only if issued before April 1, 1980)

  • Victims of human trafficking, T-visa (T-2, T-3, or T-4, etc.) holder

  • “Parolee” (You must be paroled into the United States for at least one year and you must be able to provide evidence from the USCIS that you are in the United States for other than a temporary purpose and that you intend to become a U.S. citizen or permanent resident.)

It seems like OP may qualify here (?), but they would need to confirm with legal reps and/or school FA depts. I assume OP has an I-94.

ETA: I also wonder if OP is a refugee, but they do not need to answer that here.

But Advanced Parolee status is never potentially eligible. If the status changes, it’s possible that the student could become eligible, but I don’t know for sure. The student should ask the school, and they can investigate further.

FYI, If the latest entry into the US was under advance parole, student has been paroled into the US I.e. not admitted on any specific visa or basis such as refugee, but the advance parole document is granted based on an underlying application to adjust status to permanent resident - which would be why OP stated originally that they expect to get a green card at some stage. Student status is parolee under this definition. It would definitely be useful to get the family’s immigration lawyer to help if they have one, also to get copies of the appropriate documents as listed being required showing that they intend to become a permanent resident

Thanks, I did not see that sentence initially.

But … there are special rules for Ukrainian and Afghan refugees. Not sure what they are or whether they would apply in this situation.

The student should contact the school, because they have access to specialized training materials that will allow them to help the student with their unique situation.

“Advanced parolee” would be equivalent to legal permanent resident AFAIK but you should really talk to a lawyer.
