I wonder if Victim might be liable if someone is arrested for rape because the whole incident would have been avoided if they had just had sex with someone they didn’t want to have sex with.
I’ve seen several photos of them from the event. They have no obligation to pose at all.

On Wednesday evening, May 16, the NYPD assisted the private security team protecting the Duke and Duchess of Sussex. There were numerous photographers that made their transport challenging. The Duke and Duchess of Sussex arrived at their destination and there were no reported collisions, summonses, injuries, or arrests in regard.
I work in this neighborhood and see everyday how crazy stupid scooter, moped and e-bike riders can be. I can only imagine how many times worse it was trying to follow their SUV. But the Ziegfeld Ballroom is on 54th Street between 6th & 7th Avenue. The Midtown North Precinct, one of the largest in Manhattan, is two blocks away on 54th Street between 8th & 9th Avenue. Really surprised their NYPD escort didn’t take them straight there if things were that out of hand. No need for a “2 hour chase”. Switching to a taxi to “ditch” the paparazzi was an amateur, non-New Yorker move. All medallion cabs have a sign on top with their medallion number on it. Easy to track. With the prevalence of Uber here, it’s not like they were going to somehow lose everyone in a sea of taxis in Times Square like in a Hitchcock movie. Amateur hour from both their security team and the NYPD team.
So one can believe the incident was “a bit reckless” with no arrests or summonses, per the Mayor, or “near-catastrophic” per HM. They certainly got plenty of publicity and sympathy by posters for their account, per this thread.
Other media organizations( LA, DC) have more muted reports of the incident.
The driver of the vehicle would be both civilly and possibly criminally liable for any accident or injury they directly caused. Avoiding a photo, or obtaining one, is not a defense.
I am not blaming them. I’ll rephrase my original question as it was meant as a query from a legal standpoint. America is a litigious society. None of those involved acted responsibly in the situation IMO.
“Near catastrophic” didn’t need to apply to only H and M in this situation or “chase”. The streets of NYC are busy day and night. It would have been catastrophic if innocent bystanders had been victims of a car/scooter/bike in this chase gone awry.
And I think this is what the statement was about. Scooters and bikes on sidewalks are dangerous. Behaving in such a way to get photos is stupid and dangerous.
Some clarifications on the news:
The entire incident took two hours, including the time they spent in the police station
They said they didn’t want the press following them to where they were staying, so not so much about getting their pics taken again (makes sense)
They weren’t traveling 100 miles per hour like Diana was
They may have had seatbelts on
They got in the taxi out of the police station as their car had left to try to get the press to leave
IMO, they could have left the event quietly out the back door
There was also a comment by an official (don’t know if it was a police spokesman or city) who said at one point their SUV drove into a police situation where an officer had asked for assistance so other cop cars were speeding into that area, so it made it very chaotic but that had nothing to do with their security detail. Just coincidence. I think that’s when they went to a precinct.

And the replies are all about how it’s Harry and Meghan’s fault and their spokesman was over the top in the description.
I just don’t get the hate. They have done nothing to you. They can’t even drive to their hotel after an event without someone blaming them or at the least suggesting ways you might have avoided this if you were them. Since, you know, you have so much experience being chased by paparazzi. I really don’t get why there are folks who look for reasons to hate on this couple. And yes you are doing that.
The NYPD internal investigation should reveal whether bystanders were in danger and the NY Police failed to act. HM might not have intended it, but the likely outcome of their story is an extensive internal police investigation. After all, they are indirectly accusing the police of failing to respond properly to safeguard them or the public. I hope the report is made public.
Certainly posters are entitled to their opinion. Doubting the accuracy of a click-bait media headline based upon a celebrity’s self-serving press release isn’t hate, IMO. One might query why they issued such a press release-shouldnt concerns have been expressed to the police? You are free to believe any press release they post. I am free to reserve judgment about the accuracy of it.

I think that enough electrons have been wasted on the car chase story. Move on.
It was a silly award, could’ve been received on zoom to protect safety, privacy, triggering PTSD and need of free housing in NYC.
That being said, it supports his well justified vendetta against paparazzi. To highlight their lawlessness, he has to bring attention to their current activities.
