What happened was a federal crime, taking data from servers like that where it is not meant to be public, violates more than a few federal statutes, and given that the internet crosses state lines it is likely that it will be prosecuted at a federal level, not state (I assume states could prosecute as well, of course).
Adultery is on the books in many states, but it is basically unenforcable, it is like laws on the books that don’t allow walking on your hands, that women have to wear hats on sundays, the old Sullivan law in NYC (5 years in the jug for carrying a concealed weapon without a permit), and so forth. In some states is is actionable in divorce proceedings, in others it has no relevance to divorces.
As far as the repressed sexuality within the faith the Duggars practice, or the whole ideas of being worried about males being tempted, that is a common hallmark of many conservative religious practices, there are elements of it in Judaism, Christianity and Islam in there more conservative forms. You see it with Ultra Orthodox Jews who don’t want to sit next to women on airplanes, you see it with conservative Islam where women cannot go anywhere without being escorted by a male relative, you see it in conservative Christianity with attitudes about modest dress for women and so forth. It is based in a concept that men cannot control themselves and women are ‘temptresses’ like Eve. Blaming Anna would be common in these views, since the other part is that a women’s duty is to their husband sexually, and if they cheat, must be because she wasn’t doing her duty…and typically, it says nothing about the women (and before someone goes off about denigrating the religions, I am not, this is strictly man made cultural crap translated into religious belief, the whole women as temptress/male as victim crap is old tribal, misogynistic BS…all three faiths say women are supposed to be modest, but the rest is contrived). There is still a lot of religious belief that is mired in the Medieval and before when it comes to sex and human nature, things like this just highlight that. Instead of recognizing reality and shaping their message to temper the bad sides of sex, they seek to trap it in a tight little box, and it doesn’t work.
It is also interesting reading his statement, it will be interesting if Josh shows true repentance for what he did, and by repentance not the statement he made, which is basically the old “mea culpa mea culpa I have sinned, Lord forgive me”. It means making real amends to those he affected, it means working out why he did what he did, if he is going to have Anna and the kids it would mean not only committing to them but truly making it right…and I hope he does, but I also suspect it may not be likely. One of my problems with elements of this kind of religious belief is that they treat Jesus as a get out of jail free card, they get caught in something, confess, give the weeping thing about how they failed their families and Jesus…then go on their merry way. Ted Hagerty has never fully acknowledged what he did when he got caught with a male prostitute, Jimmy Swaggert got caught with hookers how many times, Ralph Reed of the old Christian Coalition was tied up with the Abrahamoff bribery scandals, and none of them truly repented what they did, they just say Jesus is their savior and that is all they need…which means they will be likely to do it again. People make fun of progressive religious groups, but in things like this IME they emphasize, not the beliefs, not the washing away of sins, but repenting and making amends to those you have wronged, they are often stricter than the more conservative religious groups in that.
As far as people using their work e-mails, yeah, that is stupid or real ones, but that is the way people are,they figure that it will never be seen, and that is the problem. It doesn’t matter whether it is hackers, or the NSA doing data mining, very little is truly secure.
