Can a child (my brother) granted deferred action status be the beneficiary of a Florida prepaid plan? He does have a ssn.

You should contact the plan’s administrators and find out (see the contact number below). There is language in the current master contract that says “The Beneficiary must
be a United States citizen or a resident alien”. However, that may not apply whenever the plan was purchased or may be modified due to the “deferred action status”. Since they are already a beneficiary, it may also be something that’s not “checked”, i.e., it’s only a requirement to sign-up and not to use the plan.

Individuals granted deferred action status are eligible to establish Florida residency for tuition purposes.

Please contact the Florida Prepaid Collage Board and ask the question! It’s always best to hear it directly from the source.
