The readers digest version is that the judge in the case, Persky, has asked to be transferred to civil court from criminal court. Opponents still want him off the bench, saying that civil cases involving gender discrimination, or suits around sexual harassment would be problematic with him hearing them.

He will switch to hearing civil cases in a court house in San Jose, rather than criminal cases at a court house in Palo Alto. (But then someone could bring a civil suit relating to sexual assault.)

Doesn’t surprise me at all. It is exactly what most judges would request. Once you’ve had this type of attention as a judge – with the attendant threats, etc. – it would be almost impossible to get into the independent mindset on other criminal trials that you need to have as a judge. The (even unconsciousness) pressure to consider how your judgments would look to the public would undoubtedly affect your judgment in a negative way. I’ve talked to a lot of judges about this case, and all have said that they would request a transfer to a civil assignment if they were he.
An additional follow-up: Protesters armed with AR15s and shotguns have been gathering outside the Turner family home since his arrival back here in Ohio. They have stated that they will kill him if he tries to rape again. Ohio is an open carry state so, presumably, their actions are legal.
I saw news footage of this and found it to be utterly ridiculous. A few armed people - holding signs - menacing the neighborhood. They are more likely to accidentally shoot each other. Their actions serve no purpose other than furthering their own agendas. It’s not likely he will rape someone in his front yard.
Oh, come on - I deplore the guy as much as anyone else, but those protestors are holding a neighborhood and neighbors, who had absolutely nothing to do with this crime, hostage.
How’d you like to learn a group of these yahoos is going to converge on your neighborhood because some low-life got off easy for some horrible crime. You’d have to think twice every time you want to run out to the grocery store.

I’m not kidding… this story is about sending me over the edge to the point I just don’t think I can watch or read anymore news. I am truly ashamed of living in this country. How did we get to this point?
This story makes me sick on just so many levels.
Rape is pervasive in this culture in part because we accept and even encourage violence, especially among men.
We want LESS violence and threats, not more. Violence in response to violence gets us no where.
“Open Carry” usually refers to hand guns, and they must be worn on the body and uncovered. I’ve never heard of a state that allows people to stand in front of a house with a rifle or shotgun and claim ‘open carry’ allows it.
I thought open carry refers to any type of firearm. It is true that the term is most frequently used with handguns, as they are weapons that are more easily concealed. Open carry as applied to a long rifle seems rather redundant.
It’s all ridiculous and embarrassing. It’s like a third world country.
I was just thinking this is a third world country. This is a different culture than I have ever experienced. I would not feel comfortable living in this culture.
These are a dozen people out of 319 million.
I am proud of this country, not ashamed of it. I’ve been doing a lot of travelling domestically over the past two months. There are tremendous numbers of very fine people who never make the news. IMO we each have a responsibility to maintain perspective, and to acknowledge that for each and every bad act, there are dozens and dozens of selfless, generous acts that go unreported.
