[Yale Management Professor Alleges Age and Gender Discrimination in Suit - Businessweek](<a href=“Businessweek - Bloomberg”>Businessweek - Bloomberg)

I bet she loses.

Simply because women hold only 13 percent of tenured faculty positions is not evidence of gender or age discrimination. She must show a lot more than that to prove discrimination. (If you don’t agree consider this. About 80 percent of the NBA is black and, thus, the NBA discriminates against white men. Right? No. The percentage means nothing in the NBA and at Yale).

What is disturbing is Yale’s Dean’s statement that Yale needs to make greater efforts to hire women. (If you don’t agree consider this. What if the NBA says it needs to make greater efforts to hire while males? That would reveal a discriminatory intent and clearly be a problem for the NBA just as it should be for Yale.)

The sentence in the article is:

Does commitment to increase diversity also indicate discriminatory intent?

I’m not so sure she’s going to lose. For a more detailed analysis of how convoluted this case is see this article in the Yale Daily News:

On reading the article posted by jonri, it sounds to me there was someone with considerable influence who really didn’t like Bagley and made sure she didn’t get reappointed.

As an SOM grad (many years ago), this is, of course, of great interest to me. Although I don’t know many of the cast of characters well, or at all, and therefore can’t really comment, one statement from the article in YDN jumped out at me:
I do know Ted, and find this alleged comment by him to be suspect.

How do you achieve diversity? You look at race and gender and then make decisions. “increasing diversity” is just pretty language for selecting people based on race.

Let’s increase diversity in the NBA. How do we do this? We look at the race of the player and then make a decision to select that player. If race is part of the hiring decision, it is illegal discrimination.

Three committees looked at the decision and agreed. If there is discrimination, then it is probably the entire school doing the discriminating and not just a few bad apples.
